The United Kingdom Internal Market Act 2020 (Commencement No. 3) Regulations 2021

The Secretary of State, in exercise of the powers conferred by section 59(3) of the United Kingdom Internal Market Act 2020( 1), makes the following Regulations.

Citation

1.  These Regulations may be cited as the United Kingdom Internal Market Act 2020 (Commencement No. 3) Regulations 2021.

Provisions coming into force on 20th September 2021

2.  The following sections of the United Kingdom Internal Market Act 2020 come into force on 20th September 2021—

(a) section 30(1) to 30(9) (functions of the CMA under Part 4: general provisions);

(b) section 31 (objective and general functions); 

(c) section 33 (monitoring and reporting on the operation of the UK internal market); 

(d) section 34 (advising etc on proposed regulatory provisions on request); 

(e) section 35 (provision of report on request after regulatory provision is passed or made); 

(f) section 36 (report on request on provision considered to have detrimental effects); 

(g) section 37 (statements on reports under section 36); 

(h) section 38 (reports under Part 4); 

(i) section 40 (laying of annual documents before devolved legislatures); 

(j) section 44 (duty to review arrangements for carrying our Part 4 functions);

(k) section 45 (interpretation of Part 4).

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations bring into force on 20th September 2021 those sections of the United Kingdom Internal Market Act 2020 (c. 27)(“the Act”) not already in force.

Regulation 2 sets out the sections of the Act to be commenced. All of those sections fall within Part 4 of the Act, which confers on the Competition and Markets Authority, acting through the Office for the Internal Market panel and task groups, advisory, reporting, monitoring and intelligence-gathering functions to assist with the effective operation of the UK internal market.

These are the third and final commencement regulations for the Act. Previous provisions were brought into force on IP completion day (31st December 2020 at 11.00 pm) by S.I. 2020/1621, and on 14th June 2021 by S.I. 2021/706.
