The Secretary of State, in exercise of the powers conferred by section 128(1) and (2)(c) of the Armed Forces Act 2006( 1), makes the following Regulations.
In accordance with section 373(3)(c) of that Act, a draft of this instrument has been laid before Parliament and approved by a resolution of each House of Parliament.
1.—(1) These Regulations may be cited as the Armed Forces (Tri-Service Serious Crime Unit) (Consequential Amendments) (No. 2) Regulations 2022.
(2) These Regulations come into force on 5th December 2022.
(3) The amendments made by these Regulations have the same extent as the provision being amended.
2.—(1) The Armed Forces (Part 5 of the Armed Forces Act 2006) Regulations 2009( 2) are amended as follows.
(2) In regulation 8(1) (referral of case to Director of Service Prosecutions by service police: commanding officer documents and information), after “service police force”, in both places it appears, insert “or the tri-service serious crime unit( 3)”.

These Regulations make amendments to regulation 8(1) of the Armed Forces (Part 5 of the Armed Forces Act 2006) Regulations 2009 ( S.I. 2009/2055), which are consequential upon the enactment of section 12 of, and Schedule 5 to, the Armed Forces Act 2021 (c. 35)(framework for establishment of the tri-service serious crime unit) and the establishment of the tri-service serious crime unit.
A full impact assessment has not been prepared for this instrument as no, or no significant, impact on the private, voluntary or public sectors is foreseen.
For the meaning of “tri-service serious crime unit” see section 375(1A) of the Armed Forces Act 2006. Section 375(1A) was inserted by section 12(4) of the Armed Forces Act 2021 (c. 35).
