The Secretary of State makes the following Regulations in exercise of the powers conferred by section 42(2) and (3) of, and paragraph 4(1) and (3) of Schedule 1 to, the Welfare Reform Act 2012( 1).
In accordance with section 173(1)(b) of the Social Security Administration Act 1992 the Social Security Advisory Committee has agreed that the proposals in respect of these Regulations should not be referred to it( 2).
1.—(1) These Regulations may be cited as the Universal Credit (Energy Rebate Scheme Disregard) Regulations 2022 and come into force on 1st April 2022.
(2) These Regulations extend to England and Wales and Scotland.
2.—(1) Any payment a person receives under the Energy Rebate Scheme 2022 is to be disregarded for 12 months beginning with the date on which it is received in the calculation of the person’s capital for the purpose of Part 1 of the Welfare Reform Act 2012 (Universal Credit)( 3).
(2) In this regulation—
“ the Energy Rebate Scheme 2022” means the scheme to provide financial support in respect of energy bills which was announced in Parliament by the Chancellor of the Exchequer on 3rd February 2022( 4) and any comparable scheme announced by Welsh Ministers or Scottish Ministers.

These Regulations provide for a payment made from the Energy Rebate Scheme 2022 to be disregarded as capital and therefore not taken into account for the purposes of calculating entitlement to Universal Credit.
This disregard will apply to such a payment for the period of 12 months from the date the payment is received.
A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
