The M48 Motorway (Severn Bridge Speed) (Temporary Restriction of Traffic) Order 2022

The Secretary of State, in exercise of the powers conferred by section 14(1)(a) of the Road Traffic Regulation Act 1984( 1), hereby makes the following Order:

In accordance with section 14(1)(a) of that Act, the Secretary of State is satisfied that traffic on the length of road specified in this Order should be restricted because works are proposed to be executed on the M48.

Citation and commencement

1.  This Order may be cited as the M48 Motorway (Severn Bridge Speed) (Temporary Restriction of Traffic) Order 2022 and shall come into force on 27th June 2022.

Interpretation

2.  In this Order—

the M48” means (1) the westbound carriageway of the M48 Motorway from a point 239 metres west of the tip of the nosing of the westbound entry slip road at Junction 1 (Aust) to a point 47 metres west of the mechanical joint at the western end of the M48 Severn Bridge; and, (2) the eastbound carriageway of the M48 Motorway from a point 47 metres west of the mechanical joint at the western end of the M48 Severn Bridge to a point 239 metres west of the tip of the nosing of the westbound entry slip road at Junction 1 (Aust).

the works period” means the period starting at 00.01 hours on Monday 27th June 2022 and ending when the said works have been completed;

the tip of the nosing” means the first point where an entry slip road joins the carriageway of a motorway or the last point where an exit slip road leaves the carriageway of a motorway;

and a reference to an article followed by a number is a reference to the article in this Order which bears that number.

Restrictions

3.  Subject to article 4, no person shall, during the works period, drive any motor vehicle at a speed exceeding 50 miles per hour on the M48.

4.  The provision of article 3 will apply only during such times and to such extent as may, from time to time, be indicated by traffic signs and will not apply to any vehicle –

(a) being used for police, fire and rescue authority or ambulance purposes;

(b) proceeding at the direction, or with the permission, of a constable.

5.  No speed limit imposed by this order applies to vehicles falling within regulation 3(4) of the Road Traffic Exemptions (Special Forces) (Variation and Amendment) Regulations 2011( 2) when used in accordance with regulation 3(5) of those Regulations.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order authorises the temporary restriction of traffic on the M48 Motorway (Severn Bridge) as of 27th June 2022 for a maximum of 18 months because works are proposed to be carried out.
