The Trade Union Act 2016 (Commencement No. 6) Regulations 2023

The Secretary of State makes these Regulations in exercise of the powers conferred by section 25 of the Trade Union Act 2016( 1).

Citation and extent

1.—(1) These Regulations may be cited as the Trade Union Act 2016 (Commencement No. 6) Regulations 2023.

(2) These Regulations extend to England and Wales and Scotland.

Provision coming into force on 9th May 2024

2.  Section 15 of the Trade Union Act 2016 (Restriction on deduction of union subscriptions from wages in public sector), to the extent that it is not already in force, comes into force on 9th May 2024.

Explanatory Note

(This note is not part of the Regulations)

These Regulations bring into force a specified provision of the Trade Union Act 2016 (c. 15)(“ the 2016 Act”). These are the sixth commencement regulations made under the 2016 Act, and bring into force the last remaining provisions of the 2016 Act. Certain provisions came into force on the passing of the 2016 Act.

Section 15 of the 2016 Act was partially brought into force on 1st March 2017 under the Trade Union Act 2016 (Commencement No. 3 and Transitional) Regulations 2017 ( S.I. 2017/139) for the purpose of making regulations under section 116B of the Trade Union and Labour Relations (Consolidation) Act 1992 (c. 52)(“ the 1992 Act”) (as inserted by section 15 of the 2016 Act).

Regulation 2 commences the remainder of section 15 of the 2016 Act, which will come into force on 9th May 2024. Section 15 of the 2016 Act inserts section 116B into the 1992 Act (Restriction on deduction of union subscriptions from wages in public sector) and makes an insertion into section 296 of the 1992 Act (Meaning of worker and related expressions).
