The Consular Fees (Amendment) Order 2023

The King’s Most Excellent Majesty in Council

His Majesty, in exercise of the powers conferred on Him by section 1(1), (4A) and (4B) of the Consular Fees Act 1980( 1), is pleased, by and with the advice of His Privy Council, to order as follows:

Citation, commencement and extent

1.—(1) This Order may be cited as the Consular Fees (Amendment) Order 2023 and comes into force on 1st January 2024.

(2) This Order extends to England and Wales, Scotland and Northern Ireland.

Amendment of the Consular Fees Order 2012

2.—(1) The table in Part 1 of Schedule 1 to the Consular Fees Order 2012( 2) (Table of general consular fees) is amended as follows.

(2) For Fee 1 (legalising a signature or seal) substitute—

1. Legalising a signature or seal—
(i) Standard Service in the UK 45.00
(ii) Standard service in the UK (Next Day) 40.00
(iii) Digital (e-Apostille) 35.00
(iv) Urgent Service in the UK 100.00
(v) Overseas service (in addition to direct costs, if any) 40.00

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Table of General Consular Fees in the Consular Fees Order 2012 ( S.I. 2012/798as amended by S.I. 2016/373).

Article 2(2) of this Order substitutes the set of fees in Fee 1 of the Table of General Consular Fees in the Consular Fees Order 2012. Three new fees are introduced: (1) a Standard next day service fee; (2) a Digital e-apostille service fee; and (3) an Urgent Service fee. As part of these changes the Premium Service fee has been removed. Two fees have also been increased, with the fees for the Standard service in the UK and the Overseas Service rising from £30 to £45 and £30 to £40, respectively.

An Impact Assessment has not been prepared for this Order as no, or no significant, impact is foreseen on the private, voluntary or public sectors in the United Kingdom.

1980 c. 23. Subsections (4A) and (4B) were inserted by section 36 of the Identity Cards Act 2006 (c. 15)and continue to have effect by virtue of section 1(3) of the Identity Documents Act 2010 (c. 40)subject to the consequential amendment made by paragraph 2 of the Schedule to that Act.
