The Secretary of State makes these Regulations in exercise of the powers conferred by sections 88(5), 105(1), (2)(a) and (ee), and (3) of the Road Traffic Act 1988( 1).
The Secretary of State has consulted with representative organisations in accordance with section 195(2) of the Road Traffic Act 1988.
1.—(1) These Regulations may be cited as the Motor Vehicles (Driving Licences) (Amendment) Regulations 2023.
(2) These Regulations come into force on 7th July 2023.
(3) These Regulations extend to England and Wales and Scotland.
2. The Motor Vehicles (Driving Licences) Regulations 1999( 2) are amended as follows.
3. After regulation 80 (persons who become resident in Great Britain), insert—
80A.— (1) This regulation applies in respect of a person who—
(a) has entry clearance or permission to stay under the Appendix Ukraine Scheme to the Immigration Rules( 3) , and
(b) is the holder of a relevant permit within the meaning given by regulation 80(6) which was issued under the law of Ukraine.
(2) Where this regulation applies, regulation 80(1) has effect as if the reference to the period of one year after a person becomes resident in Great Britain were to the period of three years after that person becomes resident. ”.

These Regulations amend the Motor Vehicles (Driving Licences) Regulations 1999 ( S.I. 1999/2864) (“ the 1999 Regulations”).
Regulation 3 amends the 1999 Regulations to insert a new regulation 80A. The new regulation provides that individuals who have entry clearance or permission to stay under the Appendix Ukraine Scheme to the Immigration Rules (Ukraine Family Scheme, Homes for Ukraine Sponsorship Scheme, and Ukraine Extension Scheme), and are holders of licences issued in Ukraine authorising the driving of a vehicle of a class included in category A (motorcycle) and category B (car), are authorised to drive such vehicles on their Ukrainian driving licence in Great Britain for up to three years after becoming resident.
A full Impact Assessment has not been produced for this instrument as it is not expected to have significant impact on the private, public or voluntary sectors.

1988 c. 52; section 105(2)(a) was substituted by the Driving Licences (Community Driving Licence) Regulations 1996 ( S.I. 1996/1974), Schedule 1, paragraph 17(a), and amended by the Crime (International Co-operation) Act 2003 (c. 32), section 91 and Schedule 5, paragraphs 17 and 23(i), and the Road Safety Act 2006 (c. 49), section 10 and Schedule 3, paragraphs 2 and 13(1) and (2)(a), and section 105(2)(ee) was inserted by the Road Traffic (Driver Licensing and Information Systems) Act 1989 (c. 22), section 7 and Schedule 3, paragraph 14, and amended by the Road Traffic Act 1991 (c. 40), section 83 and Schedule 8.
S.I. 1999/2864, amended by S.I. 2015/583; there are other amending instruments, but none are relevant.
The Immigration Rules are made under section 3(2) of the Immigration Act 1971 (c. 77). The Appendix Ukraine Scheme was inserted to the Immigration Rules by the Statement of Changes in Immigration Rules laid before Parliament on 29 March 2022 (HC 1220, 29 March 2022).
