The Tuberculosis (Non-bovine animals) Slaughter and Compensation (England) (Amendment) Order 2024

The Secretary of State makes this Order in exercise of the powers conferred by sections 32(2) and 32(3) of the Animal Health Act 1981( 1) and now vested in the Secretary of State( 2), and with the approval of the Treasury.

Citation, commencement and application

1.—(1) This Order may be cited as the Tuberculosis (Non-bovine animals) Slaughter and Compensation (England) (Amendment) Order 2024 and comes into force on 1st January 2025.

(2) This Order applies in England only.

Amendment to the Tuberculosis (Non-bovine animals) Slaughter and Compensation (England) Order 2017

2.—(1) The Tuberculosis (Non-bovine animals) Slaughter and Compensation (England) Order 2017( 3) is amended as follows.

(2) In article 1 (citation, commencement, application and expiry), omit paragraph (3).

Explanatory Note

(This note is not part of the Order)

This Order amends the Tuberculosis (Non-bovine animals) Slaughter and Compensation (England) Order 2017 by omitting article 1(3), which provided for that Order to expire on 2nd January 2025.

A full impact assessment has not been produced for this instrument as no, or no significant impact on the private, voluntary or the public sector is foreseen. Instead a de minimis assessment has been prepared as this instrument is likely to entail some costs for businesses, but the net impact is estimated to be below £10 million per year. Functions conferred under the Animal Health Act 1981 on “the Minister” and “ the Ministers” (as defined by section 86 of that Act) are now exercisable by the Secretary of State. They were transferred, so far as exercisable by the Secretaries of State for Scotland and Wales, to the Minister of Agriculture, Fisheries and Food by S.I. 1999/3141. Functions of the Minister of Agriculture, Fisheries and Food were then transferred to the Secretary of State by S.I. 2002/794.
