The Designation of Schools Having a Religious Character (England) (Amendment and Revocations) Order 2024

The Secretary of State makes this Order in exercise of the powers conferred by section 69(3) and (4) of the School Standards and Framework Act 1998( 1), and those powers as applied in relation to independent schools by section 124B(1) and (2)( 2) of that Act.

In making this Order, the Secretary of State has followed the procedure set out in the Religious Character of Schools (Designation Procedure) Regulations 1998( 3) and the Religious Character of Schools (Designation Procedure) (Independent Schools) (England) Regulations 2003( 4).

Citation, commencement, extent and application

1.  This Order may be cited as the Designation of Schools Having a Religious Character (England) (Amendment and Revocations) Order 2024 and comes into force on the day after the day on which it is made.

2.  This Order extends to England and Wales, and applies to England.

Amendment to the Designation of Schools Having a Religious Character (Independent Schools) (England) (No. 2) Order 2013

3.—(1) The Designation of Schools Having a Religious Character (Independent Schools) (England) (No. 2) Order 2013( 5) is amended as follows.

(2) In Schedule 1, in relation to the entry for King’s School, BN41 2PG—

(a) in column 1, for ‘BN41 2PG’ substitute ‘BN3 8BN’;

(b) in column 2, for ‘Christianity’ substitute ‘Church of England’.

Revocations

4.  The following provisions are revoked—

(a) in Part 1 of the Schedule to the Designation of Schools Having a Religious Character (England) Order 1999( 6), the entries in relation to St Mary's Catholic Primary School (BD1 4EJ), St Peter's Catholic Primary School (BD3 9ND) and De La Salle Catholic High School (L11 4SG);

(b) in the Schedule to the Designation of Schools Having a Religious Character (Independent Schools) (England) (No. 2) Order 2011( 7), the title and entry in relation to The De La Salle Academy, L11 4SG.

Explanatory Note

(This note is not part of the Order)

This Order amends the entry in the Designation of Schools Having a Religious Character (Independent Schools) (England) (No. 2) Order 2013 ( S.I. 2013/2867) that relates to King’s School to reflect the changes to the school’s postcode and designation of religious character.

This Order revokes the instruments listed in article 4 to the extent set out in that article. The revocations relate to schools that have closed or that could not continue to be designated as a school with a religious character if they were to join a particular academy trust.

Designation as a school with a religious character permits the school to take account of certain religious or denominational considerations, such as when making specified employment decisions relating to teaching staff under sections 58 to 60 and 124AA of the School Standards and Framework Act 1998.

A full impact assessment has not been produced for this instrument as no, or no significant impact on the private, voluntary or public sectors is foreseen.
