The Church of England (Miscellaneous Provisions) Measure 2024 (Commencement, Transitional and Saving Provisions) Order 2024

The Archbishops of Canterbury and York, in exercise of the powers conferred by section 22(4) and (5) of the Church of England (Miscellaneous Provisions) Measure 2024( 1), make the following Order:

Citation and interpretation

1.—(1) This Order may be cited as the Church of England (Miscellaneous Provisions) Measure 2024 (Commencement, Transitional and Saving Provisions) Order 2024.

(2) In this Order, “ the Measure” means the Church of England (Miscellaneous Provisions) Measure 2024.

Commencement on 17th May 2024

2.  The Measure, so far as not already in force, except for section 11(5), comes into force on 17th May 2024.

Transitional and saving provisions

3.—(1) The amendments made by section 9(3) and (4) of the Measure (qualifications of certain judges) do not have effect in relation to a nomination made before 17th May 2024.

(2) The amendments made by section 11(3) and (4) of the Measure (applications for leave to appeal) do not have effect in relation to an application for leave to appeal made before 17th May 2024.

(3) The steps required to comply with the provisions inserted by section 13(3) and (4) of the Measure in Schedule 2 to the Ecclesiastical Jurisdiction and Care of Churches Measure 2018 (constitution of diocesan advisory committees) need not, but may, be taken before the date when the next new appointments are due to be made under paragraph 2(6) of that Schedule.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into force all the provisions of the Church of England (Miscellaneous Provisions) Measure 2024 (“the Measure”) which did not come into force on Royal Assent, except for section 11(5) (which relates to a provision of canon law providing for diocesan safeguarding officers which is not yet implemented).

Article 2 provides for the provisions of the Measure that are not already in force (except for section 11(5)) to come into force on 17th May 2024. (Sections 1, 2, 3, 5, 6, 7, 8, and 17 to 22 are already in force.)

Article 3 makes transitional and saving provision in relation to the commencement of certain provisions of the Measure.
