The Secretary of State makes these Regulations in exercise of the power conferred by section 43(1) of the Ivory Act 2018( 1).
1. These Regulations may be cited as the Ivory Act 2018 (Commencement No. 3) Regulations 2024.
2. Section 37 of the Ivory Act 2018 (meaning of “ ivory”) comes into force, insofar as it is not already in force, on the day after the day on which these Regulations are made.

These Regulations are the third commencement regulations under the Ivory Act 2018 (c. 30)(“ the Act”). These Regulations bring into force section 37 of the Act, insofar as it is not already in force. The Act prohibits all dealing in ivory, subject to the exemptions set out in sections 2 and 6 to 9.
Regulation 2 brings into force the remaining subsections of section 37 of the Act which relate to the power enabling the appropriate national authority to make regulations to amend the meaning of “ivory” to include ivory from an animal or species that is not covered by section 37(1) of the Act.
A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
