FOOD, WALES

The Meat Products (Hygiene) (Amendment) (Wales) Regulations 2000

  Made 14th July 2000
  Coming into force 31st July 2000

The National Assembly for Wales in exercise of the powers conferred on it by sections 16(1)(b),(c),(d),(e) and (f), 17(1), 26, 45, 48(1) and 49(2) of, and paragraphs 5(1), (2) and (3) and 6(1)(a) of Schedule 1 to, the Food Safety Act 1990[1], after having regard in accordance with section 48(4A) of that Act to relevant advice given by the Food Standards Agency and after consultation in accordance with section 48(4) and (4B) of that Act, and (insofar as these Regulations could not have been made under the Food Safety Act 1990) being designated[2] for the purposes of section 2(2) of the European Communities Act 1972[3] in relation to the common agricultural policy of the European Community, in exercise of the powers conferred on it by section 2(2), makes the following Regulations:

Title, application and commencement
     1. These Regulations may be cited as the Meat Products (Hygiene) (Amendment) (Wales) Regulations 2000, shall apply to Wales only and shall come into force on 31 July 2000.

Amendment to the Meat Products (Hygiene) Regulations 1994
    
2.  - (1) The Meat Products (Hygiene) Regulations 1994[4] are amended in accordance with paragraph (2) below insofar as they apply to Wales.

    (2) The following paragraph is substituted for paragraph 2(a) of Part IX of Schedule 2  - 

         " 2.

      (a) The meat product to be used in the prepared meal shall as soon as it has been cooked  - 

        (i) be mixed with the other ingredients as soon as practically possible; in that event the time during which the temperature of the meat products is between 10°C and 60°C shall not exceed two hours,

        (ii) be refrigerated to 10°C or less before being mixed with the other ingredients, or

        (iii) be cooled and mixed with the other ingredients in such a way (to be specified in the approval document for the establishment concerned) that the timing during which the temperature of the meat product is between 10°C and 60°C is kept to a minimum;".

Consequential amendment
     3. Insofar as it applies to Wales, Schedule 2 to the Products of Animal Origin (Import and Export) Regulations 1996[5] (Regulations relevant to intra-Community trade) shall be amended by the insertion of the following reference at the end of its paragraph 5  - 

    " The Meat Products (Hygiene) (Amendment) (Wales) Regulations 2000.".

EXPLANATORY NOTE

(This note does not form part of the Regulations)


    
1. These Regulations apply to Wales only. They amend  - 

    (a) the Meat Products (Hygiene) Regulations 1994 (S.I. 1994/3082, as amended); and

    (b) the Products of Animal Origin (Import and Export) Regulations 1996 (S.I. 1996/3124

in each case insofar as they apply to Wales (S.I. 1994/3082 and S.I. 1999/3124 both apply to the whole of Great Britain).

    
2. The effect of the above amendments is that in accordance with point 2(a) of Chapter IX of Annex B to Council Directive 77/99/EEC (inserted by Council Directive 95/68/EC, OJ No. L332, 30.12.95, p.10) a third method of preparation for meat-based prepared meals is permitted with effect from 31 July 2000.
