AGRICULTURE, WALES

The Agricultural Subsidies (Appeals) (Wales) (Amendment) Regulations 2003

  Made 26th February 2003 
  Coming into force 1st March 2003 

The National Assembly for Wales, in exercise of the powers conferred upon it by section 2(2) of the European Communities Act 1972[1], and of all other powers enabling it in that behalf, hereby makes the following Regulations:

Name, commencement and interpretation
     1.  - (1) These Regulations are called The Agricultural Subsidies (Appeals) (Wales) (Amendment) Regulations 2003 and come into force on 1st March 2003.

    (2) In these Regulations, "the principal Regulations" ("y prif Reoliadau") means The Agricultural Subsidies (Appeals) (Wales) Regulations 2001[
2].

Amendment of the principal Regulations
     2.  - (1) The principal Regulations are amended in accordance with the following provisions of this regulation.

    (2) In regulation 5(2) paragraph (d) is deleted.

    (3) In regulation 8(1) for "30 days" there is substituted "60 days".

    (4) In regulation 8(2) paragraph (d) is deleted.

    (5) In regulation 8(3) for "at Cathays Park, Cardiff CF10 3NQ" there is substituted "at the address set out in the decision given under regulation 7(2) above".

    (6) In regulation 11(1) for "30 days" there is substituted "60 days".

    (7) In regulation 11(3) for "at Cathays Park, Cardiff CF10 3NQ" there is substituted "at the address set out in the decision given under regulation 10(2) above".

EXPLANATORY NOTE

(This note is not part of the Regulations)


The Agricultural Subsidies (Appeals) (Wales) Regulations 2001 set up a system of agricultural appeals for Wales.

The present Regulations amend those Regulations by removing the requirement for applicants to give the grounds for their application at stages 1 and 2 of the appeals process.

They also extend the period for making such an application at stages 2 and 3 of the process from 30 days to 60 days and introduce an element of flexibility in relation to the address for service of notices.
