The Welsh Ministers, in exercise of the powers conferred by section 56(1) and (2) of the Finance Act 1973(1) and now vested in them by section 59(5) of the Government of Wales Act 2006, and paragraph 1A of Schedule 2 to the European Communities Act 1972 (2) with the consent of the Treasury, make the following Regulations.
These Regulations make provision for a purpose mentioned in section 2(2) of the European Communities Act 1972 and it appears to the Welsh Ministers that it is expedient for certain references to provisions of Community instruments to be construed as a reference to those provisions as amended from time to time.
1. The title of these Regulations is the Zoonoses and Animal By-Products (Fees) (Wales) (Amendment) Regulations 2009. They apply in relation to Wales and come into force on 28 September 2009.
2. In regulation 2 (Interpretation) of the Zoonoses and Animal By-Products (Fees) (Wales) Regulations 2008 for the definition of "official control samples" substitute the following definition–
""official control samples" ("samplau rheoli swyddogol") means samples taken by the Welsh Ministers under any of the following–
point 2.1.2.2 of the Annex to Commission Regulation (EC) No 1003/2005 implementing Regulation (EC) No 2160/2003 as regards a Community target for the reduction of the prevalence of certain salmonella serotypes in breeding flocks of Gallus gallus and amending Regulation (EC) No 2160/2003(3), as amended from time to time;
point 2.1 of the Annex to Commission Regulation (EC) No 1168/2006 implementing Regulation (EC) No 2160/2003 as regards a Community target for the reduction of the prevalence of certain salmonella serotypes in laying flocks of Gallus gallus and amending Regulation (EC) No 1003/2005(4), as amended from time to time; or
point 1(b) and (c) of the Annex to Commission Regulation (EC) No 646/2007 implementing Regulation 2160/2003 as regards a Community target for the reduction of the prevalence of certain salmonella serotypes in broiler flocks of Gallus gallus and repealing Regulation (EC) No 1091/2005(5), as amended from time to time.".

These Regulations, which apply in relation to Wales, amend the Zoonoses and Animal By-Products (Fees) (Wales) Regulations 2008 (S.I. 2008/2716) (W. 245). They make provision for the Welsh Ministers to charge fees for taking or supervising the taking of official samples required under Commission Regulation (EC) No 646/2007.
A regulatory impact assessment of the effect of these Regulations has been prepared and copies may be obtained from the Welsh Assembly Government, Cathays Park, Cardiff, CF10 3NQ.
