The Welsh Ministers,in exercise of powers conferred by section 56(1) and (2) of the Finance Act 1973(1) and now vested in them by section 59(5) of the Government of Wales Act 2006, and paragraph 1A of Schedule 2 to the European Comunities Act 1972(2) with the consent of the Treasury, make the following Regulations.
These Regulations make provision for a purpose mentioned in section 2(2) of the European Communities Act 1972 and it appears to the Welsh Ministers that it is expedient for the reference to the EU instrument in these Regulations to be construed as a reference to that instrument as amended from time to time.
1.–(1) The title of these Regulations is the Zoonoses and Animal By-Product (Fees) (Wales) (Amendment) Regulations 2010.
(2) They apply in relation to Wales.
(3) They come into force on 13 August 2010.
2.–(1) The Zoonoses and Animal By-Products (Fees) (Wales) Regulations 2008(3) are amended in accordance with the paragraph (2) of this regulation.
(2) In regulation 2 (Interpretation) within the definition of "official control samples"–
(i) omit "or" at the end of paragraph (b);
(ii) omit the full stop of the end of paragraph (c) and substitute "; or";
(iii) after paragraph (c) insert–
"(d) point 1(b)(iii) of the Annex to Commission Regulation (EC) No 584/2008 implementing Regulation 2160/2003 as regards a Community target for the reduction of the prevalence of certain salmonella serotypes in turkeys(4), as amended from time to time.".

These Regulations, which apply in relation to Wales, amend the Zoonoses and Animal By-Products (Fees) (Wales) Regulations 2008 (S.I. 2008/2716) (W. 245). They make provision for the Welsh Ministers to charge fees for taking or supervising the taking of official samples and conducting testing required under Commission Regulation (EC) No 584/2008 (OJ No L 162, 21.6.2008, p. 3).
A regulatory impact assessment of the effect that this instrument will have on the costs of business and the voluntary sector has been produced and is available from the Welsh Assembly Government, Cathays Park, Cardiff, CF10 3NQ.
