The Welsh Ministers, in exercise of the powers conferred by sections 2(5) and 262(3) of the Apprenticeships, Skills, Children and Learning Act 2009(1) make the following Regulations:
In accordance with section 262(10) of that Act, a draft of this instrument was laid before, and approved by a resolution of, the National Assembly for Wales.
1.-(1) The title of these Regulations is the Apprenticeships (Alternative Welsh Completion Conditions) Regulations 2013 and they come into force on 23 June 2013.
(2) These Regulations apply in relation to Wales.
2. The alternative Welsh completion conditions are the conditions specified in regulation 3 or 4.
3. The conditions are that-
(a)a person ("X") works as a self-employed person in connection with a recognised Welsh apprenticeship framework; and
(b)X meets the requirements specified in that framework for the purpose of the issue of an apprenticeship certificate.
4.-(1) The conditions are that-
(a)a person ("Y") entered into an apprenticeship agreement in connection with a recognised Welsh apprenticeship framework;
(b)Y started a course of training for the competencies qualification identified in that framework;
(c)throughout the duration of the first phase of the course, Y was working under the apprenticeship agreement;
(d)Y was dismissed by reason of redundancy before completing the course;
(e)Y has completed the course within 6 months from the date of such dismissal;
(f)throughout the duration of the second phase of the course, Y was working or attending a recognised vocational training centre, in connection with that framework; and
(g)Y meets the requirements specified in that framework for the purpose of the issue of an apprenticeship certificate.
(2) In paragraph (1)-
(a)the reference to the first phase of the course is to the period beginning on the day on which the course of training referred to in paragraph (1)(b) was begun and ending on the date of dismissal;
(b)the reference to the second phase of the course is to the period beginning on the day following the date of dismissal and ending on the day on which the course of training was completed.

These Regulations make provision for circumstances where a person has not entered into an apprenticeship agreement but is working under alternative working arrangements, by specifying the alternative Welsh completion conditions which will entitle them to receive an apprenticeship certificate. They apply in cases where a person works as a self employed person; and where a person has been dismissed by reason of redundancy, so that that person can complete the apprenticeship within 6 months of the date of the redundancy.
