The Welsh Ministers, in exercise of the powers conferred upon the Secretary of State by section 5 of the Landlord and Tenant Act 1985(1) and now vested in the Welsh Ministers(2), make the following Regulations:

Title and commencement

1.  (1)  The title of these Regulations is the Rent Book (Forms of Notice) (Amendment) (Wales) Regulations 2014.

(2) These Regulations come into force on 31 March 2014.

Amendment of forms

2.  In the Schedule to the Rent Book (Forms of Notice) Regulations 1982(3)-

(a)for paragraph 11 of Part I (Form for Rent Book for Restricted Contract) of the Schedule to the Regulations(4) substitute-

"You may be entitled to get help to pay your rent through the housing benefit scheme or through Universal Credit. Apply to your local council or to the Department for Work and Pensions for details. The Gov.uk website provides further advice: https://www.gov.uk";

(b)for paragraph 13 of Part II (Form for Rent Book for Protected or Statutory Tenancy) of the Schedule to the Regulations(5) substitute-

"You may be entitled to get help to pay your rent through the housing benefit scheme or through Universal Credit. Apply to your local council or to the Department for Work and Pensions for details. The Gov.uk website provides further advice: https://www.gov.uk";

(c)for paragraph 11 of Part III (Form for Rent Book for Tenancy under the Rent (Agriculture) Act 1976)(6) of the Schedule to the Regulations substitute-

"You may be entitled to get help to pay your rent through the housing benefit scheme or through Universal Credit. Apply to your local council or to the Department for Work and Pensions for details. The Gov.uk website provides further advice: https://www.gov.uk"; and

(d)for paragraph 8 of Part IV (Form for Rent Book for assured Tenancy or Assured Agricultural Occupancy)(7) of the Schedule to the Regulations substitute-

"You may be entitled to get help to pay your rent through the housing benefit scheme or through Universal Credit. Apply to your local council or to the Department for Work and Pensions for details. The Gov.uk website provides further advice: https://www.gov.uk".

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations make amendments to certain forms which are prescribed in the Rent Book (Forms of Notice) Regulations 1982(8).

These Regulations make amendments in consequence of the Welfare Reform Act 2012 (c. 5) and insert references in those forms to universal credit.

The Welsh Ministers' Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations. As a result, it was not considered necessary to carry out a regulatory impact assessment as to the likely costs and benefits of complying with these Regulations.

The functions of the Secretary of State under section 5 were, so far as exercisable in relation to Wales, transferred to the National Assembly for Wales by article 2 of and Schedule 1 to the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672). These functions now vest in the Welsh Ministers by virtue of section 162 of and paragraph 30 of Schedule 11 to the Government of Wales Act 2006 (c. 32).
