The Education (Listed Bodies) (Wales) Order 2016

The Welsh Ministers, in exercise of the powers conferred upon the Secretary of State by sections 216(2) and 232(5) of the Education Reform Act 1988(1), and now vested in them(2), make the following Order:

Title, commencement and application

1.-(1) The title of this Order is the Education (Listed Bodies) (Wales) Order 2016 and it comes into force on 18 March 2016.

(2) This Order applies in relation to Wales.

Listed bodies

2.  The bodies that are specified in the Schedule to this Order comprise all those bodies that appear to the Welsh Ministers to fall for the time being within section 216(3) of the Education Reform Act 1988.

Revocation

3.  The Education (Listed Bodies) (Wales) Order 2012(3) is revoked.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order lists the name of every body which is not a recognised body within section 216(4) of the Education Reform Act 1988 but which appears to the Welsh Ministers to either-

(a)provide a course which is in preparation for a degree to be granted by such a recognised body and is approved by or on behalf of that recognised body; or

(b)be a constituent college, school, hall or other institution of a university which is a recognised body.

"Recognised bodies" are universities, colleges, or other bodies which are authorised by Royal Charter or by or under Act of Parliament to grant degrees and other bodies for the time being permitted by those bodies to act on their behalf in the granting of degrees.

This Order updates and replaces the list of bodies contained in the Education (Listed Bodies) (Wales) Order 2012 ("the 2012 Order"). The 2012 Order is revoked by this Order. A number of bodies are omitted from the list as they no longer provide courses which are approved by or on behalf of a recognised body. The list includes bodies that were not listed in the 2012 Order, but which now provide courses that are approved by or on behalf of a recognised body. A number of minor amendments have also been made to the list to take account of the name changes since the 2012 Order.

The Welsh Ministers' Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to this Order. As a result, it was not considered necessary to carry out a regulatory impact assessment as to the likely costs and benefits of complying with this Order.

By virtue of the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672) and paragraph 30(1) and (2)(a) of Schedule 11 to the Government of Wales Act 2006 (c. 32).
