The Tertiary Education and Research (Wales) Act 2022 (Commencement No. 1) Order 2022

The Welsh Ministers, in exercise of the powers conferred by section 148(2) and (3) of the Tertiary Education and Research (Wales) Act 2022( 1), make the following Order:

Title

1.  The title of this Order is the Tertiary Education and Research (Wales) Act 2022 (Commencement No. 1) Order 2022.

Provisions coming into force on 15 December 2022

2.  The following provisions of the Tertiary Education and Research (Wales) Act 2022 come into force on 15 December 2022—

(a) section 1 (establishment of the Commission for Tertiary Education and Research);

(b) section 9(2) to (5), (7) and (8) (promoting tertiary education through the medium of Welsh);

(c) in Schedule 1 (Commission for Tertiary Education and Research)—

(i) paragraphs 1 and 2;

(ii) paragraph 3;

(iii) paragraph 4(1)(a) and (c);

(iv) paragraph 5(1) and (2);

(v) paragraph 7(1) and (2);

(vi) paragraph 10(1), (3), (4) and (7);

(vii) paragraph 11(1) only for the purpose of appointing the chair of the Research and Innovation Committee, and (2);

(viii) paragraph 12.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into force provisions of the Tertiary Education and Research (Wales) Act 2022 (“ the Act”) which are listed in article 2 and come into force on 15 December 2022.

The provisions listed in article 2 enable the establishment of the Commission for Tertiary Education and Research (“ the Commission”) and the designation of a person to give advice to the Commission in respect of the Commission’s duty to promote tertiary education through the medium of Welsh.

Article 2(a) commences section 1 of the Act which provides for the establishment of the Commission and introduces Schedule 1. Schedule 1 makes further provision about the Commission such as membership, staffing, procedure, committees, and audit.

Article 2(b) commences certain provisions of section 9 of the Act which require the Welsh Ministers to designate a person to give advice to the Commission for the purpose of assisting it to discharge its duty to promote tertiary education through the medium of Welsh.

Article 2(c) commences certain provisions of Schedule 1 which provide for the appointment of the chair, deputy chair (who, in accordance with paragraph 1 of that Schedule, is the chair of the Research and Innovation Committee of the Commission), ordinary members and chief executive of the Commission. It also commences certain procedural requirements relating to the appointment of certain associate members.
