The Welsh Ministers in exercise of the powers conferred on them by sections 26, 27, 39 and 150(5) of the Welsh Language (Wales) Measure 2011( 1), having received the approval of Senedd Cymru( 2) in accordance with section 150(2) of that Measure, make the following Regulations.

Title and coming into force

1.—(1) The title of these Regulations is the Welsh Language Standards (No. 1, No. 2, No. 4, No. 6 and No. 7) Regulations (Amendment) Regulations 2025.

(2) These Regulations come into force on 28 March 2025.

Amendment of the Welsh Language Standards (No. 1) Regulations 2015

2.—(1) The Welsh Language Standards (No. 1) Regulations 2015( 3) are amended as follows.

(2) In regulation 1(4), in the definition of “body”, after “a corporate joint committee” insert “, Welsh Revenue Authority”.

(3) After regulation 3(2) insert—

(3)  The Welsh Ministers authorise the Welsh Language Commissioner to give a compliance notice to the Welsh Revenue Authority requiring it to comply with any of the following standards specified under regulation 2—

(a) 1 to 144;

(b) 147 to 172;

(c) 175 and 176.

Amendment of the Welsh Language Standards (No. 2) Regulations 2016

3.  In Schedule 6 to the Welsh Language Standards (No. 2) Regulations 2016( 4) at the appropriate places insert—

Boundary Commission for Wales (“ Comisiwn Ffiniau i Gymru ”)”;

“Future Generations Commissioner for Wales (“ Comisiynydd Cenedlaethau’r Dyfodol Cymru ”)”;

“Qualifications Wales (“ Cymwysterau Cymru ”)”;

“Trustees of the National Heritage Memorial Fund (“ Ymddiriedolwyr Cronfa Goffa’r Dreftadaeth Genedlaethol ”) .

Amendment of the Welsh Language Standards (No. 4) Regulations 2016

4.—(1) The Welsh Language Standards (No. 4) Regulations 2016( 5) are amended as follows.

(2) In regulation 3(2)(a), before “the Agricultural Land Tribunal (Wales)” insert “the Adjudication Panel for Wales,”.

(3) In Schedule 6, at the appropriate place insert “Adjudication Panel for Wales(“Panel Dyfarnu Cymru”).

Amendment of the Welsh Language Standards (No. 6) Regulations 2017

5.  After regulation 3(4) of the Welsh Language Standards (No. 6) Regulations 2017( 6) insert—

(5)  Health Education and Improvement Wales requiring it to comply with standards 90 and 90A specified under regulation 2 and Schedule 1.

Amendment of the Welsh Language Standards (No. 7) Regulations 2018

6.—(1) In regulation 1(4) of the Welsh Language Standards (No. 7) Regulations 2018( 7)—

(a) in the definition of “national health service clinic” for “or a National Health Service Trust” substitute “, a National Health Service Trust or a Special Health Authority”;

(b) in the definition of “national health service hospital” for “or a National Health Service Trust” substitute “, a National Health Service Trust or a Special Health Authority”;

(2) In Schedule 6, at the appropriate place insert “Special Health Authorities(Awdurdodau Iechyd Arbennig).

EXPLANATORY NOTE

(This note is not part of the Regulations)

The Welsh Language (Wales) Measure 2011 (nawm 1)(“the Measure”) makes provision for the specification of standards of conduct in relation to the Welsh language (“standards”).

Section 25 of the Measure requires a person to comply with a standard, which is specified by the Welsh Ministers, if, in addition to other conditions being met, the person is liable to be required to comply with standards and the standard is potentially applicable to the person.

Section 26 of the Measure enables the Welsh Ministers to specify standards by regulations, and section 39 enables them to provide that a standard is specifically applicable to a person by authorising the Welsh Language Commissioner (“ the Commissioner”) to give a notice to that person requiring compliance with the standard (a “ compliance notice”).

The Welsh Language Standards (No. 1) Regulations 2015, the Welsh Language Standards (No. 2) Regulations 2016, the Welsh Language Standards (No. 4) Regulations 2016, the Welsh Language Standards (No. 6) Regulations 2017 and the Welsh Language Standards (No. 7) Regulations 2018 (“ the Standards Regulations”) specify standards. The Standards Regulations also authorise (subject to certain exceptions) the Commissioner to give a compliance notice, in relation to standards specified by the Standards Regulations, to various bodies.

These Regulations amend the Standards Regulations to authorise the Commissioner to give a compliance notice, in respect of the standards specified in the Standards Regulations, to additional bodies.

These Regulations are connected to the Welsh Language (Wales) Measure 2011 (Amendment of Schedule 6) Order 2025. The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to that Order and these Regulations. As a result, a regulatory impact assessment has been prepared dealing with these Regulations and that Order.
