AN ACT SO TO AMEND ARTICLE 66 OF THE CONSTITUTION AS TO TERMINATE THE RIGHT OF APPEAL TO HIS MAJESTY IN COUNCIL.
|
|
|

BE IT ENACTED BY THE OIREACHTAS OF SAORSTÁT EIREANN AS FOLLOWS:—
|
|
|
|
|
|
|
|
|
|
|
Amendment of Article 66 of the Constitution.
|
1.—Article 66 of the Constitution is hereby amended as follows, that is to say:—
|
|
|
( a ) by the deletion from that Article of the proviso thereto, beginning with the words "Provided that" and ending with the words "such leave," and
|
|
|
( b ) by the insertion in that Article of the following words in the place of the said proviso, that is to say:— "and no appeal shall lie from a decision of the Supreme Court or of any other Court in the Irish Free State (Saorstát Eireann) to His Majesty in Council, and it shall not be lawful for any person to petition His Majesty for leave to bring any such appeal."

Appeals from existing judgments and orders.
|
2.—The amendments made by this Act in Article 66 of the Constitution shall, in relation to judgments and orders pronounced or made by the Supreme Court before the passing of this Act, apply and have effect in regard to the institution and prosecution, after the passing of this Act, of an appeal or a petition for leave to appeal from any such judgment or order and to the further proceeding, after the passing of this Act, with an appeal or a petition for leave to appeal from any such judgment or order which was instituted before such passing.

Short title.

3.—This Act may be cited as the Constitution (Amendment No. 22), Act, 1933.
