DUBLIN TRAFFIC (PARKING AND WAITING) (AMENDMENT) BYE-LAWS, 1941. | ||||||||||||||||||||||||||||||||||||||||||||||||||||
WHEREAS it is enacted by sub-section (1) of section 150 of the Road Traffic Act, 1933 (No. 11 of 1933), that the Commissioner of the Gárda Síochána may, with the consent of the Minister for Local Government and Public Health and after consultation with the local authority concerned, make in respect of any specified area bye-laws for all or any of the purposes mentioned in that sub-section in relation to keeping or leaving mechanically propelled vehicles stationary in public places : | ||||||||||||||||||||||||||||||||||||||||||||||||||||
AND WHEREAS section 147 of the said Road Traffic Act, 1933 , confers on the Commissioner of the Gárda Síochána power to make, with the consent of the Minister for Local Government and Public Health, bye-laws for the general regulation and control of traffic in respect of the whole of the State or any portion of an area therein : | ||||||||||||||||||||||||||||||||||||||||||||||||||||
AND WHEREAS the Dublin Traffic (Parking and Waiting) Bye-Laws, 1937 (Statutory Rules and Orders, No. 242 of 1937), were made by the Commissioner of the Gárda Síochána under the said subsection (1) of section 150 of the Road Traffic Act, 1933 : | ||||||||||||||||||||||||||||||||||||||||||||||||||||
AND WHEREAS the Commissioner of the Gárda Síochána has, before making the bye-laws hereinafter set forth, consulted the Right Honourable the Lord Mayor, Aldermen, and Burgesses of Dublin, the Council of the County of Dublin, and the Corporation of Dun Laoghaire. | ||||||||||||||||||||||||||||||||||||||||||||||||||||
NOW, I, MÍCHEÁL Ó CUINNEÁIN, Commissioner of the Gárda Síochána, in exercise of the powers conferred on me by sub-section (1) of section 150 of the Road Traffic Act, 1933 (No. 11 of 1933), and of the powers conferred on me by section 147 of the said Act, and of every and any other power me in this behalf enabling, hereby, with the consent of the Minister for Local Government and Public Health testified by his official seal affixed hereto, make the following bye-laws in respect of the Dublin Metropolitan Area, that is to say :— | ||||||||||||||||||||||||||||||||||||||||||||||||||||

1.—(1) These bye-laws may be cited as the Dublin Traffic (Parking and Waiting) (Amendment) Bye-Laws, 1941. | ||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) The principal bye-laws and these bye-laws may be cited together as the Dublin Traffic (Parking and Waiting) Bye-Laws, 1937 and 1941. | ||||||||||||||||||||||||||||||||||||||||||||||||||||
The principal bye-laws and construction therewith. | ||||||||||||||||||||||||||||||||||||||||||||||||||||
2.—(1) In these bye-laws the expression " the principal bye-laws " means the Dublin Traffic (Parking and Waiting) Bye-Laws, 1937 (Statutory Rules and Orders, No. 242 of 1937). | ||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) These bye-laws shall be construed together with the principal bye-laws, and accordingly every word or expression to which a particular meaning is assigned in the principal bye-laws for the purpose of those bye-laws has in these bye-laws the meaning so assigned to it. | ||||||||||||||||||||||||||||||||||||||||||||||||||||
Interpretation. | ||||||||||||||||||||||||||||||||||||||||||||||||||||
3. The Interpretation Act, 1937 (No. 38 of 1937), applies to these bye-laws. | ||||||||||||||||||||||||||||||||||||||||||||||||||||
PART II. WAITING ELSEWHERE THAN IN PARKING PLACES. | ||||||||||||||||||||||||||||||||||||||||||||||||||||

General provisions in relation to the keeping of vehicles waiting in streets. | ||||||||||||||||||||||||||||||||||||||||||||||||||||
4. The following provisions shall apply and have effect in relation to the conditions under which vehicles may be kept waiting in streets in the Dublin Metropolitan Area at places in those streets which are neither parking places nor places at which such waiting is for the time being prohibited by the principal bye-laws as amended by these bye-laws, that is to say :— | ||||||||||||||||||||||||||||||||||||||||||||||||||||
(a) no person shall keep a vehicle waiting in the night-time in any street in the Dublin Metropolitan Area for a continuous period exceeding six hours ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||
(b) no person shall keep a vehicle waiting in any street at a place in respect of which there is an authorised sign prohibiting the keeping of vehicles waiting at such place ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||
(c) no person shall keep a vehicle waiting in any street at a place which is an appointed stand for large public service vehicles or an appointed standing for street service vehicles ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||
(d) no person shall keep a vehicle waiting in any such place, position, or manner as to obstruct, delay, or interfere with the entrance to or exit from a fire brigade station maintained by a local authority or an ambulance station similarly maintained ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||
(e) no person shall keep a vehicle waiting at or near a street junction in such position that such vehicle or any part thereof is inside, or within fifteen feet on either side from, the space between the prolongation into the street in which such vehicle is waiting of the building lines on each side of a street entering such first mentioned street on the side thereof on which such vehicle is waiting ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||
(f) no person shall keep a vehicle waiting in any street in such place, position, or manner that there is not sufficient space between such vehicle and one side of such street or between such vehicle and any stationary vehicle or other object on the opposite side of such street for the free movement of the normal flow of vehicular traffic through such street ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||
(g) wherever a roadway crosses or enters another roadway and the traffic at the junction of such roadways is controlled by mechanical signals operated by road detector pads, no person shall keep any vehicle waiting for any purpose or time (other than bona fide awaiting permission from such signals to proceed and for so long only as is bona fide necessary for that purpose) wholly or partly within any of the spaces on such roadways the boundaries of which (whether wholly or partly marked on the roadway or not so marked at all) are as follows, that is to say :— | ||||||||||||||||||||||||||||||||||||||||||||||||||||
(i) a side of one of the said roadways on or adjacent to which a standard or other support carrying lamps forming part of the said mechanical signals is situate, and | ||||||||||||||||||||||||||||||||||||||||||||||||||||
(ii) a line from the said support to the centre line of the said roadway in a direction at right angles to the said side of the said roadway, and | ||||||||||||||||||||||||||||||||||||||||||||||||||||
(iii) the centre line of the said roadway, and | ||||||||||||||||||||||||||||||||||||||||||||||||||||
(iv) a line from a point on the said side of the said roadway to the centre line of the said roadway in a direction at right angles to the said side, the said point being situate twenty feet (measured along the said side and in the direction away from the said support) from the road detector pad in the said roadway which would ordinarily be crossed by traffic approaching the said support along the said roadway between the said side thereof and the centre line thereof ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||
(h) the conditions under which a vehicle may remain stationary in a public place (other than a parking place) in the Dublin Metropolitan Area shall include the conditions that such vehicle shall rest wholly on the roadway and shall not rest partly on a footway and that no portion of or attachment to such vehicle shall project over a footway, and accordingly no person shall keep or leave a vehicle stationary in any such public place otherwise than in accordance with the foregoing conditions ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||
(i) the driver, owner, or other person in charge of a vehicle waiting in a street shall comply immediately with all directions given to him by a member of the Garda Siochana in relation to the keeping of such vehicle waiting at such place or the removal of such vehicle from such place. | ||||||||||||||||||||||||||||||||||||||||||||||||||||
Restrictions on vehicles waiting at stopping places for large public service vehicles. | ||||||||||||||||||||||||||||||||||||||||||||||||||||
5.—(1) In this bye-law— | ||||||||||||||||||||||||||||||||||||||||||||||||||||
the expression " stopping place for large public service vehicles " means a point on a roadway (whether it is or is not for the time being appointed by the Commissioner under section 118 as a point at which large public service vehicles or large public service vehicles of a particular kind may stop for the purpose of taking up and setting down passengers) the position of which is indicated by a sign, and | ||||||||||||||||||||||||||||||||||||||||||||||||||||
the word " sign " means a metal plate which has delineated thereon the word " bus " and is affixed to a support situate at the side of the roadway, whether erected specially to support such plate or already existing for some other purpose and whether actually on such roadway or on the adjoining footway or other ground. | ||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) In addition to the provisions of the next preceding bye-law of these bye-laws, the following provisions shall apply and have effect in relation to the conditions under which vehicles may be kept or left stationary in streets in the Dublin Metropolitan Area at places in those streets which are neither parking places nor places at which such waiting is for the time being prohibited by the principal bye-laws as amended by these bye-laws, that is to say :— | ||||||||||||||||||||||||||||||||||||||||||||||||||||
(a) where, at a stopping place for large public service vehicles, a space is demarcated by means of lines painted or otherwise marked or indicated on the surface of the roadway, no person shall keep or leave a vehicle stationary in such position that it is wholly or partly within the space so demarcated ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||
(b) where, at a stopping place for large public service vehicles, no space is demarcated in the manner mentioned in the foregoing sub-paragraph, no person shall keep or leave a vehicle stationary in such position that it is wholly or partly within a space (along that side of the roadway on which the sign indicating the position of such stopping place is situate) extending, in length, for a distance of twenty feet in each direction from the said sign and, in breadth throughout, for ten feet from the edge of the roadway on the said side thereof. | ||||||||||||||||||||||||||||||||||||||||||||||||||||

6. Bye-law 13 of the principal bye-laws is hereby revoked. | ||||||||||||||||||||||||||||||||||||||||||||||||||||
Prohibition of keeping or leaving vehicles on a footway. | ||||||||||||||||||||||||||||||||||||||||||||||||||||
7. No person shall keep or leave a vehicle stationary on (whether wholly or partly) a footway in the Dublin Metropolitan Area. | ||||||||||||||||||||||||||||||||||||||||||||||||||||

11.—(1) The Fourth Schedule to the principal bye-laws is hereby amended by the insertion therein at the end thereof of the several items numbered 15 to 24 set out in the Fourth Schedule to these bye-laws. | ||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) The principal bye-laws, and in particular paragraph (1) of bye-law 12 thereof, shall be construed and be given effect with due regard to the amendment made by this bye-law in the Fourth Schedule to those bye-laws. | ||||||||||||||||||||||||||||||||||||||||||||||||||||

12.—(1) The Fifth Schedule to the principal bye-laws is hereby amended by the deletion therefrom of item number 10 (Anglesea Street). | ||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) The Fifth Schedule to the principal bye-laws is hereby further amended by the insertion therein at the end thereof of the several items numbered 18 to 21 set out in the Fifth Schedule to these bye-laws. | ||||||||||||||||||||||||||||||||||||||||||||||||||||
(3) The principal bye-laws, and in particular paragraph (2) of bye-law 12 thereof, shall be construed and be given effect with due regard to the amendments made by this bye-law in the Fifth Schedule to those bye-laws. | ||||||||||||||||||||||||||||||||||||||||||||||||||||
