CIVIL SERVICE (EMERGENCY BONUS) REGULATIONS, 1944. | ||||||||||||||||||||||||||||||||||
WHEREAS it is enacted by subsection (1) of section 9 of the Civil Service Regulation Act, 1924 (No. 5 of 1924), as adapted in consequence of the enactment of the Constitution, that the Minister for Finance may from time to time make regulations for controlling the Civil Service of the State and providing for the classification remuneration, and other conditions and terms of service of all persons employed therein, whether permanently or temporarily : | ||||||||||||||||||||||||||||||||||
AND WHEREAS it is enacted by subsection (3) of section 2 of the Ministers and Secretaries Act, 1924 (No. 16 of 1924), that there shall be paid to all officers and servants appointed by any Minister such salaries and remunerations as the Minister for Finance may from time to time determine : | ||||||||||||||||||||||||||||||||||
NOW, I, SEÁN T. Ó CEALLAIGH, Minister for Finance, in exercise of the powers conferred on me by subsection (1) of section 9 of the Civil Service Regulation Act, 1924 (No. 5 of 1924), and of the powers conferred on me by subsection (3) of section 2 of the Ministers and Secretaries Act, 1924 (No. 16 of 1924), and of every and any other power me in this behalf enabling, hereby make the following regulations :— | ||||||||||||||||||||||||||||||||||
1.—(1) These Regulations may be cited as the Civil Service (Emergency Bonus) Regulations, 1944. | ||||||||||||||||||||||||||||||||||
(2) The Civil Service (Stabilisation of Bonus) Regulations, 1940 to 1943, and these Regulations may be cited together as the Civil Service (Stabilisation of Bonus) Regulations, 1940 to 1944. | ||||||||||||||||||||||||||||||||||
2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations. | ||||||||||||||||||||||||||||||||||
3. In these Regulations— | ||||||||||||||||||||||||||||||||||
the expression "the Principal Regulations" means the Civil Service (Stabilisation of Bonus) Regulations, 1940 ( S. R. & O. No. 177 of 1940 ) ; | ||||||||||||||||||||||||||||||||||
the expression "the 1942 Regulations" means the Civil Service (Stabilisation of Bonus) (Amendment) Regulations, 1942 ( S. R. & O. No. 258 of 1942 ) ; | ||||||||||||||||||||||||||||||||||
the expression "the 1943 Regulations" means the Civil Service (Emergency Bonus) Regulations, 1943 ( S. R. & O. No. 1 of 1943 ) ; | ||||||||||||||||||||||||||||||||||
the words " whole-time " and " part-time " have the same meanings as they respectively have in the 1942 Regulations ; | ||||||||||||||||||||||||||||||||||
the expression " standard remuneration " means the remuneration which would be payable to a person if these Regulations had not been made excluding such (if any) increase as would then be payable to him by virtue of the 1942 Regulations or the 1943 Regulations, and also excluding any payment made to him in respect of overtime or by way of allowance in respect of children ; | ||||||||||||||||||||||||||||||||||
any reference to an amount related to a year shall include a reference to the corresponding amount related to a week, and any reference to an amount related to a week shall include a reference to the corresponding amount related to a year. | ||||||||||||||||||||||||||||||||||
4.—(1) These Regulations apply to every person to whom the Principal Regulations for the time being apply. | ||||||||||||||||||||||||||||||||||
(2) In the application of these Regulations to a person who is, at the date of these Regulations, a person to whom the Principal Regulations apply, the word " remuneration," when used without qualification, means remuneration payable in respect of a period beginning on or after whichever of the following dates is the later, that is to say, the 1st day of January, 1944, or the date on which the Principal Regulations began to apply to him. | ||||||||||||||||||||||||||||||||||
5. The remuneration of a person mentioned in the second column of the Schedule to this Order at any particular reference number shall include the emergency bonus stated in the third column of that Schedule at that reference number, but subject to the limitation or limitations (if any) stated in the fourth column of that Schedule at that reference number and subject also, if such person is provided with free board, or free rations, or an allowance in lieu of free board or free rations and an increase would be payable to him by virtue of the 1943 Regulations if these Regulations had not been made, to the limitation that the difference between the emergency bonus and such increase shall not exceed— | ||||||||||||||||||||||||||||||||||
(a) in the case of a whole-time person, two shillings a week, | ||||||||||||||||||||||||||||||||||
(b) in the case of a part-time person, two shillings a week or ten per cent. of the standard remuneration, whichever is the less. | ||||||||||||||||||||||||||||||||||
6. Neither the 1942 Regulations nor the 1943 Regulations shall apply in relation to remuneration which includes the emergency bonus under these Regulations. | ||||||||||||||||||||||||||||||||||
