CONSULTATIVE HEALTH COMMITTEES (DUBLIN, CORK, LIMERICK AND WATERFORD) REGULATIONS, 1963.

CONSULTATIVE HEALTH COMMITTEES (DUBLIN, CORK, LIMERICK AND WATERFORD) REGULATIONS, 1963.

The Minister for Health, in exercise of the powers conferred on him by subsection (8) of section 48 of the Health Act, 1953 (No. 26 of 1953), as amended by subsection (14) of section 24 of the Health Authorities Act, 1960 (No. 9 of 1960), hereby makes the following Regulations:--

1. These Regulations may be cited as the Consultative Health Committees (Dublin, Cork, Limerick and Waterford) Regulations, 1963.

2. The Consultative Health Committees (Dublin, Cork and Waterford) Regulations, 1954 ( S.I. No. 73 of 1954 ), and the Consultative Health Committees (Dublin, Cork and Waterford) (Amendment) Regulations, 1955 ( S.I. No. 31 of 1955 ), are hereby revoked.

3. There shall be established, in accordance with these Regulations:--

(a) a consultative health committee for the county borough of Dublin and the county of Dublin;

(b) a consultative health committee for the county borough of Cork and the county of Cork;

(c) a consultative health committee for the county borough of Limerick and the county of Limerick; and

(d) a consultative health committee for the county borough of Waterford and the county of Waterford.

4.--(1) In this Article----

"the Authority" means the Dublin Health Authority;

"the Manager" means the manager for the purposes of the County Management Acts, 1940 to 1955, for the Authority.

(2) The consultative health committee established under these regulations for the county borough of Dublin and the county of Dublin shall be known as the Dublin Consultative Health Committee.

(3) An appointment of members of the Dublin Consultative Health Committee shall be made by resolution as soon as may be after the making of these Regulations and thereafter at the annual meeting held next after every quinquennial appointment of members of the Authority.

(4) The functions of the Dublin Consultative Health Committee shall be to advise the Manager and the Chief Executive Officer of the Authority on general matters (other than conditions of employment of officers and servants, the amount or payment of grants or allowances or the making of any service available to an individual) relating to the exercise of the functions of the Authority in relation to the operation of the Health Acts, 1947 to 1960.

(5) The Dublin Consultative Health Committee shall consist of seventeen members who shall include--

(a) not less than six members of the Authority;

(b) the Dublin Chief Medical Officer;

(c) one other senior medical officer of the Authority;

(d) four other registered medical practitioners each of whom is resident in the county borough of Dublin or the county of Dublin, and each of whom is nominated by a body which, in the opinion of the Authority, is representative of registered medical practitioners practising in the said county borough or county;

(e) one person concerned with the management of a voluntary hospital in the county borough of Dublin or the county of Dublin.

(6) Subsection (4), (5) and (6) of section 48 of the Health Act, 1953 , shall apply to the Dublin Consultative Health Committee with the following modifications:--

(a) reference to the council of the county shall be construed as references to the Authority;

(b) references to the county manager shall be construed as references to the Manager or the Chief Executive Officer of the Authority.

5.--(1) In this article--

"the Authority" means the Cork Health Authority;

"the Manager" means the manager for the purposes of the County Management Acts, 1940 to 1955, for the Authority.

(2) The consultative health committee established under these Regulations for the county borough of Cork and the county of Cork shall be known as the Cork Consultative Health Committee.

(3) An appointment of members of the Cork Consultative Health Committee shall be made by the Authority by resolution as soon as may be after the making of these Regulations and thereafter at the annual meeting held next after every quinquennial appointment of members of the Authority.

(4) The functions of the Cork Consultative Health Committee shall be to advise the Manager on general matters (other than conditions of employment of officers and servants, the amount or payment of grants or allowances or the making of any service available to an individual) relating to the exercise of the functions of the Authority in relation to the operation of the Health Acts, 1947 to 1960.

(5) The Cork Consultative Health Committee shall consist of sixteen members who shall include--

(a) not less than six members of the authority;

(b) the Cork Chief Medical Officer;

(c) one other senior medical officer of the Authority;

(d) four other registered medical practitioners residing in the county of Cork or the county borough of Cork, each of whom is nominated by a body which, in the opinion of the Authority, is representative of registered medical practitioners practising in the said county or county borough.

(6) Subsections (4), (5) and (6) of section 48 of the Health Act, 1953 , shall apply to the Cork Consultative Health Committee with the following modifications:--

(3) An appointment of members of the Limerick Consultative Health Committee shall be made by the Authority by resolution as soon as may be after the making of these Regulations and thereafter at the annual meeting held next after every quinquennial appointment of members of the Authority.

(4) The functions of the Limerick Consultative Health Committee shall be to advise the Manager on general matters (other than conditions of employment of officers and servants, the amount or payment of grants or allowances or the making of any service available to an individual) relating to the exercise of the functions of the Authority in relation to the operation of the Health Acts, 1947 to 1960.

(5) The Limerick Consultative Health Committee shall consist of fourteen members who shall include--

(a) not less than six members of the Authority;

(b) the Limerick Chief Medical Officer;

(c) one other senior medical officer of the Authority;

(d) three other registered medical practitioners residing in the county of Limerick or the county borough of Limerick, each of whom is nominated by a body which, in the opinion of the Authority, is representative of registered medical practitioners practising in the said county or county borough.

EXPLANATORY NOTE.

These regulations provide for the establishment of consultative health committees in the Dublin, Cork, Limerick and Waterford areas to advise as respects executive functions performed for the Health Authorities established for these areas for the revocation of earlier regulations dealing with similar committees.
