ARRANGEMENT OF BYE-LAWS.

Bye-Law.

1. Short title.

WHEREAS the Commissioner of the Garda Síochána has, before making the bye-laws hereinafter set forth, consulted the council of the urban district of Ennis in regard thereto:

NOW, I, WILLIAM P. QUINN, Commissioner of the Garda Síochána, in exercise of the powers conferred on me by section 84 of the Road Traffic Act, 1961 (No. 24 of 1961), and with the consent of the Minister for Local Government, make the following bye-laws in respect of the area comprising the urban district of Ennis.

Short title.

1. These bye-laws may be cited as the Ennis Appointed Stands (Street Service Vehicles) Bye-Laws, 1965.

Definitions.

2. In these bye-laws--

" street " means a public road ;

reference to the head of an appointed stand shall be construed as referring to that end of the appointed stand from which the limits of the appointed stand are reckoned in column (3) of the Schedule to these bye-laws ;

references to the rear of an appointed stand shall be construed as referring to that end of the appointed stand to which the limits of the appointed stand are reckoned in column (3) of the Schedule to these bye-laws ;

references to the order of the vehicles on an appointed stand shall be construed as referring to the order of the vehicles reckoned from the head of the appointed stand towards the rear of the appointed stand.

Revocation.

3. The Ennis Appointed Standings (Street Service Vehicles) Bye-Laws, 1940 ( S.R. & O. No. 144 of 1940 ) are hereby revoked.

Appointment of appointed stands.

4. In a street or portion of a street mentioned in column (2) of the Schedule to these bye-laws, the place delimited in column (3) of that Schedule opposite the mention in the said column (2) of such street or portion shall be an appointed stand available, subject to these bye-laws, for use without limitation as to time or occasion of user.

Position of vehicles on appointed stands.

5.--(1) For the purpose of these bye-laws, a street service vehicle shall be deemed not to be standing for hire on an appointed stand unless the whole of the vehicle is within the limits of the appointed stand as stated in column (3) of the Schedule to these bye-laws.

(2) Every street service vehicle standing for hire on an appointed stand shall be placed--

(a) in the position specified in column (5) of the Schedule to these bye-laws opposite the mention of the appointed stand in column (3) of that Schedule, and

(b) in case there is no street service vehicle already on the appointed stand, at the head of the appointed stand and, in any other case, next in order to the street service vehicle or the last of the street service vehicles already on the appointed stand,

and a street service vehicle shall be deemed for the purposes of these bye-laws not to be standing for hire on the appointed stand unless placed thereon in accordance with this paragraph.

(3) Where the Schedule to these bye-laws requires a street service vehicle standing for hire on an appointed stand to be placed in single line by the kerb and parallel thereto or with the rear of the vehicle to the kerb a vehicle shall not be placed more than eighteen inches from the kerb.

Maximum number of street service vehicles at an appointed stand.

6. Whenever the number of street service vehicles standing for hire on an appointed stand is equal to the number mentioned in column (4) of the Schedule to these bye-laws opposite the mention of the appointed stand in column (3) of that Schedule, the driver of any street service vehicle not already so standing for hire shall not place that street service vehicle on that appointed stand.

Vacancies at appointed stands.

7. Whenever a vacancy occurs at an appointed stand by reason of the departure therefrom of a street service vehicle, the street service vehicle nearest to the space so vacated shall be moved by its driver into that space and thereupon each driver of any other street service vehicle then standing on that appointed stand shall in turn move his vehicle into the space which is next in order to him and is in the direction of the head of the appointed stand.

General provisions relating to appointed stands.

8. The following provisions shall apply in respect of street service vehicles standing for hire on an appointed stand :--

(a) a person shall not wash, overhaul or execute repairs to a street service vehicle while it is standing for hire on an appointed stand, except such repairs as may be necessary to enable the street service vehicle to be removed from the appointed stand ;

(b) neither the driver of a street service vehicle which is standing for hire nor any other person shall make any unnecessary noise by means of or in relation to the vehicle or the engine or any equipment, fittings or instruments fitted to or carried on the vehicle or any loudspeaker in or on or in any way connected with the vehicle ;

(c) the driver of a street service vehicle which is placed on, being brought into or removed from an appointed stand shall comply with all directions given to him by a member of the Garda Siochana in relation to the placing of the street service vehicle on the appointed stand or the bringing of the street service vehicle into or the removal of the street service vehicle from the appointed stand.

General restriction on street service vehicles standing for hire.

9. A driver of a street service vehicle shall not stand the street service vehicle for hire otherwise than on an appointed stand and in accordance with these bye-laws.

WHEREAS in pursuance of section 6 of the Road Traffic Act, 1961 , (No. 24 of 1961), the Commissioner has submitted the foregoing bye-laws to the Minister for Local Government ;

AND WHEREAS subsections (1) and (5) of the said section 6 have been complied with in relation to the said bye-laws :

NOW, THEREFORE, the Minister for Local Government, in exercise of the power conferred on him by section 84 of the said Act, hereby consents to the making of the said bye-laws.

EXPLANATORY NOTE

These bye-laws--

(a) Revoke the Ennis Appointed Standings (Street Service Vehicles) Bye-Laws, 1940.

(b) Appoint stands for street service vehicles, and

(c) Prohibit the driver of a street service vehicle from standing the vehicle for hire elsewhere than on an appointed stand.
