I, ERSKINE H. CHILDERS, Minister for Transport and Power, in exercise of the powers conferred on me by section 5 of the Merchant Shipping (Amendment) Act, 1939 (No. 12 of 1939), section 5 of the Merchant Shipping (Safety Convention) Act, 1952 (No. 29 of 1952), as extended by section 3 of the Merchant Shipping Act, 1966 (No. 20 of 1966), section 4 of the Mercantile Marine Act, 1955 (No. 29 of 1955), and the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959
( S.I. No. 125 of 1959 ), and with the consent of the Minister for Finance, hereby order as follows :

|
1.--(1) This Order may be cited as the Merchant Shipping (Fees) Order, 1968.
|
|
|
(2) This Order shall come into operation on the 9th day of September, 1968.
|
|
|
2. In this Order--
|
|
|
"tons" means gross tons, and the gross tonnage of a ship having alternative gross tonnages shall be taken to be the larger of those gross tonnages;
|
|
|
"the Regulations" means the Merchant Shipping (Tonnage) Regulations, 1967 ( S.I. No. 213 of 1967 ), and references to Regulations by their number shall be construed accordingly;
|
|
|
"Part II tonnage" means the gross and register tonnages of a ship ascertained in accordance with Part II of the Regulations ;
|
|
|
"modified tonnage" means the gross and register tonnages of a ship ascertained in accordance with Regulation 13 ;
|
|
|
"alternative tonnage" means the alternative gross and register tonnages of a ship ascertained in accordance with Regulation 14.
|
|
|
3. There shall, subject to and in accordance with the provisions of the Schedules to this Order, be charged and paid, in respect of each matter mentioned in any of those Schedules, the fee specified in that Schedule in respect of that matter.
|
|
|
4. The Merchant Shipping (Fees) Order, 1963 ( S.I. No. 266 of 1963 ), and the Merchant Shipping (Cargo Ship Survey Fees) Order, 1967 ( S.I. No. 150 of 1967 ), are hereby revoked.
|

NOTES.
|
|
|
I. Except where otherwise stated, the appropriate fees must be paid before any survey, inspection (other than an inspection relating to a certificate mentioned in Article 1) or service can be undertaken. In cases where the fee cannot be assessed beforehand (e.g. tonnage measurements), a deposit sufficient to cover the probable charge is required and any outstanding expenses or balance of fees must be paid before the case is completed.
|
|
|
II. Fees and expenses under this Schedule, other than these mentioned in Articles 6, 7, 21, 22, 23, 24 and 25, must in every case be paid to the Superintendent of a Mercantile Marine Office and not to Surveyors.
|
|
|
III. An official Receipt is GIVEN for all payments.
|
|
|

NOTES
|
|
|
I. The fees specified in paragraph (a) above must be paid in full in respect of a new ship or a ship coming under survey for the first time even though a certificate for twelve months may not be required. In other cases when a certificate for less than twelve months is required the fee shall be in proportion to the period from the date of termination of the survey to the date of expiration of the certificate at the rate of l/12th of the full fee for each month or part of a month :
|
|
|
Provided that the fee payable shall in no case be less than--
|
|
|
(i) in the case of a ship not exceeding 100 tons, 3/12ths of a twelve months' fee or £22, or
|
|
|
(ii) in the case of a ship exceeding 100 tons, 3/12ths of a twelve months' fee or £33
|
|
|
whichever is the greater.
|
|
|
II. In any case in which the duration of the certificate has been limited by the Surveyor's declaration owing to special reasons rendering one or more further surveys necessary within the ensuing twelve months the total fees paid for certificates covering the period of twelve consecutive months shall not exceed that payable for a twelve months' certificate.
|
|
|
III. The fees specified at paragraphs (a), (b) and (c) above--
|
|
|
(i) include the fees for the survey of the ship and are not returnable when the survey has been carried out, and the certificate cannot be issued due to a deficiency of the hull, equipment or machinery of the ship ;
|
|
|
(ii) cover any number of visits which a Surveyor may require to make before granting his declaration and include the survey of the hull, boilers and propelling machinery (including tests of the materials), and the inspection of the equipment of the ship, including the lights and fog signals. The full fee under subparagraph (a) covers a survey for loadline if both surveys are made at the same time. It does not, however, include inspection of the crew spaces (Article 11 (c)), or measurement for tonnage (Article 6).

4. Fees for the inspection of life-saving appliances.
|
|
|
(a) For the inspection on the application of the owner (not being an inspection made with a view to the issue of a passenger certificate or of any of the certificates referred to in sections 20 and 22 of the Merchant Shipping (Safety Convention) Act, 1952 ), under section 431 of the Merchant Shipping Act, 1894, as amended by section 13 of the Merchant Shipping (Safety Convention) Act, 1952 , of a ship other than a passenger steamer either during construction of the ship or otherwise for the purpose of seeing that the ship complies with the rules made under section 427 of the Merchant Shipping Act, 1894, as amended by
section 11 (1) of the Merchant Shipping (Safety Convention) Act, 1952 , and section 10 of the Merchant Shipping Act, 1966 .

Other Fees
|
|
|
(a) Annual survey carried through in one operation--
|
|
|
For every annual survey of any ship of over 300 tons (classed or unclassed) which is carried through in one operation there shall be paid--
|
|
|
(i) the standard fee, and
|
|
|
(ii) in addition, a single fee of £11 0s. 0d. if for the purposes of the survey more than one visit is paid to the ship by the Surveyor.
|
|
|
(b) Annual survey not carried through in one operation-- For every annual survey of any ship (classed or unclassed) which is not carried through in one operation there shall be paid--
|
|
|
(i) the standard fee,
|
|
|
(ii) in addition, a fee of £11 0s. 0d. for every partial annual survey, and
|
|
|
(iii) for any ship of over 300 tons, in addition, a singel fee of £11 0s. 0d. for every partial annual survey in respect of which, for the purposes of the partial annual survey, more than one visit is paid to the ship by the Surveyor.
|
|
|
(c) Renewal survey carried out concurrently with a special survey for classification purposes--
|
|
|
In the case of the survey of a classed ship for renewal of the Load Line Certificate, the fee specified in column (2) in the table of Standard Fees shall be paid if the renewal is carried out concurrently with a special survey for classification purposes, for which a fee is charged. Otherwise the fee shall be half that specified in Column (1) of the said Table.
|
|
|
(d) Issue or renewal survey carried out concurrently with survey for Passenger or Passenger and Safety Certificate--
|
|
|
Where the survey for the issue or renewal of a Load Line Certificate is carried out by a Surveyor concurrently with that for a Passenger or Passenger and Safety Certificate, and the ship is :--
|
|
|
(i) a classed ship--no fee shall be charged under column (1) or column (2) of the said Table ;
|
|
|
(ii) an unclassed ship--half the fee under column (4) or column (5) of the said Table shall be paid.
|
|
|
(e) Annual survey carried out concurrently with survey for Passenger or Passenger and Safety Certificate--
|
|
|
Where the annual load line survey is made at the same time as the survey for the issue of a Passenger or Passenger and Safety Certificate, no fee shall be charged under column (3) or column (6).
|
|
|
(f) Survey where minor alterations have been made to a ship--
|
|
|
Where minor alterations have been made to a ship having a Load Line Certificate in force, which involve an alteration of the freeboard but do not require a full survey, the fee in column (2) shall be paid whether the ship is classed or unclassed.
|
|
|
(g) Partial survey for issue of a short-term certificate--
|
|
|
Where for special reasons a partial survey is made and a certificate is issued or renewed for a period not exceeding twelve months, one half of the standard fee appropriate to a full survey shall be paid.
|
|
|
(h) Issue or renewal survey carried out concurrently with survey for Cargo Ship Safety Construction Certificate--
|
|
|
Where the survey of a cargo ship for the issue or renewal of a Load Line Certificate is carried out by a Surveyor concurrently with that for a Cargo Ship Safety Construction Certificate, the fee payable in respect of the issue or renewal of the Load Line Certificate shall be half that which would be otherwise payable.
|
|
|
(i) Annual Survey carried out concurrently with intermediate survey carried out in accordance with the Merchant Shipping (Cargo Ship Construction and Survey) Rules, 1967 ( S.I. No. 99 of 1967 ).
|
|
|
NOTE : where the annual load line survey is carried out by a Surveyor at the same time as the intermediate survey required under the Merchant Shipping (Cargo Ship Construction and Survey) Rules, 1967, no fee shall be payable in respect of the annual load line survey.
|
|
|
8. Fees for survey for seaworthiness
|
|
|
|

|
(a) for the survey of a ship by direction of a Court under Section 463 of the Merchant Shipping Act, 1894--

12. Surveyors' fees: |
(a) Surveyors' Expenses : |
Except where otherwise stated and apart from overtime fees referred to in paragraphs (c) and (d) of this Article, no separate fees are payable for Surveyors' expenses or subsistence in the State or in Northern Ireland in addition to the fees set out in the preceding paragraphs except--
|
(i) where a Surveyor is called to a survey or inspection by the owner and is prepared to carry it out but is prevented from doing so by circumstances which it was within the power of the owner, his servants or agents to prevent
|
|
|
|
or
|
|
|
|
|
|
(ii) where a Surveyor is called upon to carry out a partial survey away from a normal survey centre for the purpose of the issue of a short-term certificate.
|
(b) Surveys abroad: |
The relevant survey fees together with a fee equivalent in amount to the Surveyor's travelling and subsistence expenses.
|
All fees and a deposit to cover the travelling and subsistence expenses must be paid in advance in the case of surveys abroad and an undertaking given for the payment of any balance of fees and expenses connected with the service.

For inspections in connection with the illumination from a ship of lifeboats in the process of and after launching and for tests of lifeboat searchlights, one-half the fees specified in this subparagraph.

Periods of less than one hour will be charged as one hour according to the scale.
|
|
|
|
For periods exceeding one hour, one-quarter fee will be charged for each quarter or part quarter of an hour, according to the scale. The maximum fee in any one case shall be limited to that for 10 hours.
|
|
|
Application for services by Surveyors out of office hours should be made on the prescribed form. The application must include an undertaking to pay the overtime fees.
|
|
|
The fees cover the services of all Surveyors.
|
|
|
Where the service cannot be commenced at the hour stated in the application or cannot be completed without interruption or if there is delay after completion, the time during which the Surveyors are kept waiting shall be charged at half the full appropriate overtime rate subject to a maximum fee of £48 10s.
|
|
|
Time occupied in travelling will not be deemed over-time except time spent on a tender between the shore and the ship which will be charged at half the full overtime rates.
|
|
|

1. The fees under this paragraph shall not be charged to Government Departments or to Consuls or other representatives of foreign Governments when the inspection, etc., is required for official purposes.

|
The agreement and official log book of a ship for one voyage, or in case of running agreements (Home or Foreign Trade) for one half year, are to be regarded as constituting one record.
|
|
|
When certificates are lost by shipwreck or fire at sea, renewals or copies shall be issued without fee.
|
|
|
II. This fee is for the attendance of an officer for one day only. An additional charge of 9s. 6d. a day shall be made for each document produced.
|
|
|
If an officer attends to produce documents at the hearing of two or more separate cases in the same Court on the same day, only one attendance fee shall be charged if the solicitor requiring the attendance is the same in all the cases. If different solicitors are concerned the full attendance fee shall be charged for each case. In either event the fee of 9s. 6s. a day for each document produced shall be charged.

|
III. No charge shall be made for a Seaman's Record Book and Certificates of Discharge (Dis. A) when the original has been lost through shipwreck or fire at sea or for a continuation book when the original has been filled.

"certifying authority" means the Minister or other person authorised by the Minister to issue a cargo ship safety construction certificate;
|
|
|
"surveyor of ships" means a surveyor appointed by a certifying authority.
|
|
|
21. Subject to Articles 22, 23, 24 and 25 fees in accordance with the following Table of Fees shall be paid for surveys carried out in accordance with the Merchant Shipping (Cargo Ship Construction and Survey) Rules, 1967.

22. Where a surveyor appointed by a certifying authority other than the Minister carries out concurrently with a survey for classification purposes a survey before the issue or renewal of a Cargo Ship Safety Construction Certificate or an intermediate survey no fees shall be payable under the preceding paragraph.
|
|
|
23. Where a surveyor of ships carries out a survey before the issue of a Cargo Ship Safety Construction Certificate on a ship the keel of which was laid before the 14th May, 1967, the fee payable on such survey shall be four times the amount shown in column (3) of the Table of Fees in Article 21.
|
|
|
24. Where a surveyor of ships carries out a survey before the renewal of a Cargo Ship Safety Construction Certificate or an intermediate survey and such a survey is not completed in one operation but is effected by two or more partial surveys there shall be paid, in addition to the fees payable under column (3) or column (4), as the case may be, of the Table of Fees in Article 21 :--

|
|
(a) a fee of £20 for every partial survey, and
|
|
|
(b) a further fee of £20 for every additional visit when more than one visit is paid to the ship by the surveyor for the purposes of such a partial survey.
|
|
|
25. Where a surveyor of ships carries out a survey of a ship for the issue in respect of a ship of a Cargo Ship Safety Construction Certificate which it is intended shall remain in force for a period not exceeding three months, and the ship is one in respect of which there is, or within the period of twelve months immediately preceding the survey there has been, in force a passenger certificate, the fee payable for such survey shall be as follows:

|
(a) if the survey is carried out before or within one month after the expiry of the certificate--£25; and
|
|
|
(b) if the survey is carried out more than one month but within twelve months after the expiry of the certificate--£50.
|

THIRD SCHEDULE
|
|
|
FEES OF RECEIVERS OF WRECK
|
|
|
NOTE
|
|
|
Fees under this Schedule must be paid to the appropriate Receiver of Wreck.
|
|
|
1. For every report required to be sent by a Receiver of Wreck to the Secretary of Lloyd's in London the fee payable shall be £1 2s. 6d.
|
|
|
2. For wreck taken into his custody by a Receiver of Wreck the fee payable shall be five per cent. of the value of the wreck: Provided that in no case shall the amount so payable exceed £50.
|
|
|
3. In cases in which any services are rendered by a Receiver of Wreck in respect of any ship in distress, not being a wreck, or in respect of the cargo or articles belonging to the ship, the following fees shall be payable:
|
|
|
(a) if the ship with her cargo equals or exceeds £1,200 in value, a fee of £4 for the first, and £2 for every subsequent day during which the Receiver is employed in that service; and
|
|
|
(b) if the ship with her cargo is less in value than £1,200, one half of the amounts mentioned in paragraph (a) of this Article.
|
|
|
4. In addition to the fees mentioned in the foregoing Articles of this Schedule the expenses incurred in a particular case by a Receiver of Wreck shall be payable.
|
|
