PLANNING AND DEVELOPMENT REGULATIONS 2002.

The Minister for the Environment and Local Government, in exercise of the powers conferred on him by sections 33, 97, 179, 231, 238 and 262 of the Planning and Development Act 2000 ( No. 30 of 2000 ) hereby makes the following Regulations:

Citation and commencement.

1.         (1)       These Regulations may be cited as the Planning and Development Regulations 2002.

(2)       These Regulations and the Planning and Development Regulations 2001 shall be construed as one and may be collectively cited as the Planning and Development Regulations 2001 to 2002.

(3)       These Regulations shall come into operation on 11 March 2002.

Interpretation.

2.                     In these Regulations, except where the context otherwise requires, “the Regulations” means the Planning and Development Regulations 2001.

Modifications to scales of location maps.

3.         (1)       Articles 22(2)(b), 48(2), 83(1)(b), 187(1)(h) and 194(2)(c) of the Regulations are hereby amended by the substitution respectively of “1:2500” for “1:1250”.

(2)        Any map referred to in articles 22(2)(b), 48(2), 83(1)(b), 187(1)(h) and 194(2)(c) of the Regulations which is based on an Ordnance Survey map shall indicate thereon the relevant Ordnance Survey sheet number.

Amendment of article 22 of Regulations.

4.                     Article 22(2)(b) of the Regulations shall be amended by the substitution of “and marked so as to identify clearly the land or structure to which the application relates and the boundaries thereof in red, any land which adjoins, abuts or is adjacent to the land to be developed and which is under the control of the applicant or the person who owns the land which is the subject of the application in blue and any wayleaves in yellow,” for “and marked or coloured so as to identify clearly the land or structure to which the application relates and the boundaries thereof,”.

Amendment of article 23 of Regulations.

5.                     Article 23(1)(a) of the Regulations is hereby amended by the deletion of “land which adjoins, abuts or is adjacent to the land to be developed and which is under the control of the applicant or the person who owns the land which is the subject of the application shall be outlined in blue and any wayleaves shall be shown in yellow,”.

These Regulations modify the scales of location maps to be used in areas other than built-up areas. The details to be indicated on location maps to be submitted with a planning application are also modified.
