SOCIAL WELFARE (MISCELLANEOUS PROVISIONS) ACT, 2002 (SECTION 16) (COMMENCEMENT) ORDER, 2002 |

The Minister for Social and Family Affairs, in exercise of the powers conferred on her by section 17 of the Social Welfare (Miscellaneous Provisions) Act, 2002 ( No. 8 of 2002 ), hereby orders as follows: |

1. This Order may be cited as the Social Welfare (Miscellaneous Provisions) Act, 2002 (Section 16) (Commencement) Order, 2002. |

Commencement. |
2. Section 16 of the Social Welfare (Miscellaneous Provisions) Act, 2002 , in so far as it relates to the Combat Poverty Agency Act, 1986 (No. 14 of 1986) and the Family Law (Maintenance of Spouses and Children) Act, 1976 (No. 11 of 1976) shall come into operation on 9 August 2002. |

This order provides for the commencement of certain provisions of section 16 of the Social Welfare (Miscellaneous Provisions) Act 2002 in relation to the amendment of the Combat Poverty Agency Act, 1986 and the Family Law (Maintenance of Spouses and Children) Act, 1976 with effect from the 9th August, 2002. |

The amendment to the Combat Poverty Agency Act provides for the payment of fees and certain expenses to members of the Combat Poverty Agency. |

The amendment to the Family Law (Maintenance of Spouses and Children) Act 1976 provides that a Court can order that periodical maintenance payments awarded under the Act, commence at any time from the date of the original application for the maintenance order. This in effect allows the Court to back-date the maintenance order to the date the proceedings commenced or at any time during the intervening period. |
