Freedom of Information Act 1997 (Prescribed Bodies) (No. 2) Regulations 2002


I, Charlie McCreevy, Minister for Finance, in exercise of the powers conferred on me by section 3 of the Freedom of Information Act 1997 ( No. 13 of 1997 ) and to the extent that these Regulations relate to the respective functions of the Minister for Communications, Marine and Natural Resources, the Minister for Arts, Sport and Tourism, the Minister for the Environment and Local Government, the Minister for Agriculture and Food, the Minister for Community, Rural and Gaeltacht Affairs and the Minister for Transport, with the consent of each of those Ministers, hereby make the following regulations with respect to which, pursuant to section 3(3) of that Act, a draft has been laid before each House of the Oireachtas and a resolution approving of the draft has been passed by each such House:

1.         These Regulations may be cited as the Freedom of Information Act 1997 (Prescribed Bodies) (No. 2) Regulations 2002.

2.         These Regulations come into operation with effect from 1 November 2002.

3.         The bodies, organisations and groups specified in the Schedule to these Regulations stand prescribed for the purposes of paragraph 1(5) of the First Schedule to No. 13 of 1997 ).

Cólucht Groighe Náisiúnta na hEireann Teoranta (The Irish National Stud Company Limited),

Area Development Management Limited,

National Drugs Strategy Team,

The Western Development Commission,

The Dublin Transportation Office,

An tÚdarás urn Bóithre Náisiúnta or, in the English language, the National Roads Authority,

The Railway Procurement Agency or, in the Irish language, An Ghníomhaireacht um Fháil

National Development Plan -Community Support Framework Evaluation Unit,

The Minister for Communications, Marine and Natural Resources consents to the making of these Regulations to the extent that they relate to the functions of that Minister.

These Regulations prescribe each of the bodies listed in the schedule as a public body for the purposes of the Freedom of Information Act, 1997 (No. 13 of 1997) by their inclusion in subparagraph (5) of paragraph 1 of the First Schedule to that Act.
