Merchant Shipping (Passenger Boat) (Amendment) Regulations 2002

I, Dermot Ahern, Minister for Communications, Marine and Natural Resources in exercise of the powers conferred on me by section 18 of the Merchant Shipping Act 1992 ( No. 2 of 1992 ) as amended by section 44 of the Merchant Shipping (Investigation of Marine Casualties) Act 2000 ( No. 14 of 2000 ) as adapted by the Marine and Natural Resources (Alteration of Name of Department and Title of Minister) Order 2002 ( No. 307 of 2002 ) hereby make the following Regulations:

1.         These Regulations may be cited as the Merchant Shipping (Passenger Boat) (Amendment) Regulations 2002.

2.         The Merchant Shipping (Passenger Boat) Regulations 2002 are amended as follows:

(1)        in Regulation 1(ii) by substituting “1 January 2003” for “6th day of June 2003”,

(2)        in Regulation 2 by inserting “service” after “mobile satellite” in the definition of “Satellite EPIRB”,

(3)        in Regulation 2 in the definition of “existing passenger boat” by substituting “1 August 2002 and before 1 January 2003” for “31st December 2002 and before 6th June 2003” in each place where it occurs,

(4)        in Regulation 7(4)(c)(v) by inserting “cockpit” after “open”,

(5)        in Regulation 7(4)(f)(vii)(b) by substituting “P3” for “P2”,

(6)        in Regulation 8(1)(1) by substituting “be provided with an approved waterproofed hand-held marine VHF radio” for “be provided with a suitably waterproofed hand-held VHF radio for communication with a responsible person on shore”,

(7)        in Regulation 9(2)(d) by inserting “COSPAS-SARAT satellite” before “EPIRB”,

(8)        in Regulation 10(4) by deleting the comma after “LENGTH”,

(9)        in Regulation 10(4)(h) by substituting “(i)” for “(h)” at the beginning of this paragraph and by indenting this paragraph,

(10)      in Regulation 10(4)(i) by substituting “(ii)” for “(i)” at the beginning of the subparagraph, by indenting this paragraph, by inserting “such” before “passenger”, by substituting “provided that” for “under the following conditions;-”, and by deleting “(i)” in front of “all persons”,

(11)      in Regulation 10(4)(j) by substituting “(h)” for “(j)”,

(12)      in Regulation 10(5) by substituting “CLASS P6 PASSENGER BOATS OF 24 METRES OR LESS IN LENGTH ENGAGED IN SAILING ACTIVITIES” for “PASSENGER BOATS, OF 24 METRES OR LESS IN LENGTH, ENGAGED IN SAILING ACTIVITIES”, and

(13)      in Regulation 10(5) by substituting “Regulation 10 (1) and (2)” for “Regulation 10(1),(2) and (3)”.

EXPLANATORY NOTE

(THIS NOTE IS NOT PART OF THE INSTRUMENT AND DOES NOT PURPORT TO BE A LEGAL INTERPRETATION)

These Regulations amend the Merchant Shipping (Passenger Boat) Regulations 2002 bringing forward the commencement date to 1 January 2003 and making minor technical and drafting amendments to the requirements of the Regulations.
