European Communities (Seed Potatoes) (Amendment) Regulations 2003 |

I, Joe Walsh, Minister for Agriculture and Food, in exercise of the powers conferred on me by Section 3 of the European Communities Act, 1972 ( No 27 of 1972 ) and for the purposes of giving effect to Article 11.2 of Council Directive 2002/56/EC of 13 June 2002(1) hereby make the following Regulations: 1. (1) These Regulations may be cited as the European Communities (Seed Potatoes) (Amendment) Regulations, 2003. |

(2) The European Communities (Seed Potatoes) Regulations 1980 to 1999 and these Regulations may be cited together as the European Communities (Seed Potatoes) Regulations 1980 to 2003. 2. The European Communities (Seed Potatoes) Regulations, 1980 ( S.I. No 343 of 1980 ) are hereby amended by the insertion of the following Regulation after Regulation 8: |

“ 8 (A) Paragraphs (1) and (4) of Regulation 7 and Regulation 8 of these Regulations shall not apply to packages containing less than 10 kg of basic seed potatoes, packed for retail sale to the end consumer: |

(a) Where, at the time of sale there is conspicuously displayed on or in close proximity to the basic seed potatoes a statement setting out the information listed in Part IV of the Schedule to these Regulations; |

or |
||||||
(b) Packaged in new containers upon each of which there is printed on otherwise legibly or indelibly marked on to or in which there is attached or inserted a label setting out the information contained in Part IV of the Schedule to these Regulations. “ |

These Regulations amend the European Communities (Seed Potatoes) Regulations (S.I. 343 of 1980), to allow a simplification of requirements for the sealing and labelling of small packages of seed Potatoes. |
