FOREIGN POST AMENDMENT (NO. 39) SCHEME 2004.

AN POST, in exercise of the powers conferred on it by Section 70 of the Postal and Telecommunications Act 1983 (No. 24 of 1983) as amended by Regulation 8(4) of the European Communities (Postal Services) Regulations 2002 ( S.I. No. 616 of 2002 ) hereby makes the following Scheme:

1. This Scheme may be cited as the Foreign Post Amendment (No. 39) Scheme 2004.

2. This Scheme shall be operative with effect from the 5th day of January 2004.

3. In this Scheme--

“Principal Warrant” means the Foreign Post Warrant of 1949 ( S.I. No. 267 of 1949 ) as amended;

“Scheme No. 27” means the Foreign Post Amendment (No. 27) Scheme 1985 ( S.I. No. 95 of 1985 );

“Scheme No. 29” means the Foreign Post Amendment (No. 29) Scheme 1986 ( S.I. No. 91 of 1986 );

“Scheme No. 31” means the Foreign Post Amendment (No. 31) Scheme 1989 ( S.I. No. 364 of 1989 );

“Scheme No. 33” means the Foreign Post Amendment (No. 33) Scheme 1991 ( S.I. No. 96 of 1991 );

“Scheme No. 34” means the Foreign Post Amendment (No. 34) Scheme 1998 ( S.I. No. 132 of 1998 );

“Scheme No. 37” means the Foreign Post Amendment (No. 37) Scheme 2002 ( S.I. No. 638 of 2002 );

“Scheme No. 38” means the Foreign Post Amendment (No. 38) Scheme 2003 ( S.I. No. 477 of 2003 ).

4. Words defined in the Principal Warrant shall have the same meaning in this Scheme.

5. The entries in the First Schedule to this Scheme are hereby substituted for the entries in the First Schedule (as inserted by Regulation 6 of Scheme No. 38) to the Principal Warrant.

6. The entries in the Second Schedule to this Scheme are hereby substituted for the entries in the Second Schedule (as inserted by Regulation 7 of Scheme No. 38) to the Principal Warrant.

7. Scheme No. 37 is hereby revoked.

8. The First Schedule of Scheme No. 27 (as amended by Regulation 3 of Scheme No. 29, Regulation 11 of Scheme No. 31 and Regulation 9 of Scheme No. 33) is hereby revoked. The Second Schedule to Scheme No. 27 is also hereby revoked. The rates or charges for the International Express Mail Service shall be those rates and charges as published by An Post from time to time. Paragraphs 1 and 2 of Regulation 10 of Scheme No. 27 are hereby amended by the substitution of those paragraphs with the following paragraphs:

“10. (1) There shall be charged and paid upon Express Mail Packets the rates as specified from time to time by An Post together with, as An Post may require any or all of the charges referred to in Regulation 9(2) or 10(2) of this Scheme.

10. (2) Persons who have made an arrangement pursuant to Regulation 4 hereof may obtain the customs services at the charges specified by An Post from time to time. The said customs services specified in this paragraph shall not be made available to any person by An Post unless and until An Post shall deem such services to be in operation, by means of a Scheme executed pursuant to Section 70 of the Postal and Telecommunications Services Act 1983 .”

Maximum dimensions:

Length, width and depth combined: 900 mm, greatest dimension not exceeding 600 mm, with a tolerance of 2 mm. (In roll form: length and twice diameter: 1,040 mm, greatest dimension not exceeding 900 mm, with a tolerance of 2 mm).

EXPLANATORY NOTE.

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

This Scheme applies to the Foreign Post Service and shall be operative with effect from 5th day of January 2004. It authorises increases in the postage rates for letters, packets and other services. It allows rates and charges connected with the International Express Mail Service to be published by An Post from time to time.
