WHEREAS I, Brian Cowen, Minister for Finance, am of the opinion that the bodies specified in the following regulations ought, in the public interest and having regard to the provisions and spirit of the Ethics in Public Office Act 1995 (No. 22 of 1995) (hereafter referred to as “the Act”), to be prescribed: |

AND WHEREAS I consider that it is necessary in the public interest to prescribe the positions of employment in the public bodies specified in the following regulations for the purposes of the definition of “designated position” in section 2 of the Act in order to ensure, in a case in which, in my opinion, a conflict could arise between an interest referred to in section 18 of the Act and the public interest in the performance of a function of such a position, that the function will not be performed without the disclosure of the first-mentioned interest: |

AND WHEREAS it is appropriate to prescribe the amount of remuneration of a person as special adviser, for the purposes of section 19(3)(a): |
||||||||
NOW THEREFORE, I, Brian Cowen, Minister for Finance, in exercise of the powers conferred on me by section 3 of, and paragraph 1(13) of the First Schedule to, the Act and after consultation with such other Ministers of the Government as I consider appropriate, hereby make the following regulations: 1. These Regulations may be cited as the Ethics in Public Office (Designated Positions in Public Bodies) Regulations 2004. 2. These Regulations come into operation on 1 January 2005. 3. (1) In these Regulations - |

“Act” means Ethics in Public Office Act 1995 ( No. 22 of 1995 ); |
||||||||
“Civil Service” has the same meaning as it has in the Civil Service Regulation Act 1956 (No. 46 of 1956); |
||||||||
“position” means position of employment. |
||||||||
(2) In these Regulations a reference to a Schedule is a reference to the Schedule to these Regulations, unless it is indicated that a reference to some other provision is intended. 4. The following positions are prescribed for the purposes of the definition of “designated position” in section 2 of the Act: |
||||||||
(a) a position as a principal (general service grade, Class B PRSI) in the Civil Service, |
||||||||
(b) a position in any public body specified in subparagraphs (1) to (7) of paragraph 1 of the First Schedule to the Act, in respect of which the maximum salary is not less than the maximum salary of a principal (general service grade, Class B PRSI) in the Civil Service, and |
||||||||
(c) a position specified in the Schedule in the public body or part of the public body specified in relation to the position. 5. The amount of the maximum salary (standard scale, Class B PRSI) of a higher executive officer in the Civil Service is prescribed for the purposes of section 19(3)(a) of the Act. 6. The following are prescribed for the purposes of section 18(3)(b)(v) of the Act: |

(a) the office of the Director of Public Prosecutions, |
||||||||
(b) the office of an Appeal Commissioner for the purposes of the Income Tax Acts within the meaning of the Taxes Consolidation Act 1997 (No. 39 of 1997), |
||||||||
(c) the office of the Director of Corporate Enforcement, |
||||||||
(d) the office of the Information Commissioner, |
||||||||
(e) the office of the Registrar of Friendly Societies, |
||||||||
(f) the office of the Ombudsman for Children, and |
||||||||
(g) the office of the Pensions Ombudsman. 7. The Ethics in Public Office (Designated Positions in Public Bodies) Regulations 1996 ( S.I. No. 57 of 1996 ) are revoked. |

These regulations are made under the Ethics in Public Office Act 1995 (No. 22 of 1995) to apply the provisions of the Act to individuals occupying specified positions in the Civil Service. The Regulations designate certain positions in the Civil Service as “designated positions” as defined in Section 18 of the Act. Persons occupying positions designated in these regulations are required to furnish a statement of registrable interests (as defined in the Second Schedule to the Act) to the relevant authority (as defined in Section 18 of the Act) within their organisation. |

The relevant authority in each of the bodies will be specified by the Minister for Finance and details will be available in an Appendix to the Standards in Public Office Commission’s “Guidelines on compliance with the provisions of The Ethics in Public Office Acts 1995 and 2001 -- Public Servants (Third Edition)”. |
