HARBOUR RATES (BALTIMORE AND SKIBBEREEN HARBOUR) ORDER 2005

I, Pat the Cope Gallagher, Minister of State at the Department of Communications, Marine and Natural Resources, in exercise of the powers conferred on me by section 104 of the Harbours Act 1946 ( No. 9 of 1946 ), the Communications (Transfer of Departmental Administration and Ministerial Functions) Order 1987 ( S.I. No. 91 of 1987 ) (as adapted by the Marine and Natural Resources (Alteration of Name of Department and Title of Minister) Order 2002 ( S.I. No. 307 of 2002 ) and the Marine (Delegation of Ministerial Functions) (No.2) Order 2004 ( S.I. No. 703 of 2004 )), and after due compliance with section 106 of the said Act, hereby order as follows:

1.         This Order may be cited as the Harbour Rates (Baltimore and Skibbereen Harbour) Order 2005.

2.         (1)        The rates set out in -

(a)        Schedule 1 to this Order are fixed as the maximum rates to be charged for lighthouse dues,

(b)        Schedule 2 to this Order are fixed as the maximum rates to be charged for gross registered tonnage on fishing vessels and cargo and commercial vessels, and

(c)        Schedule 3 to this Order are fixed as the maximum rates to be charged for passenger vessels,

by Baltimore and Skibbereen Harbour Commissioners in respect of Baltimore and Skibbereen Harbour.

3.         Where the rates fixed under this Order are payable per tonne or per ton, lesser weights shall be chargeable at a weight calculated to the nearest first decimal place.

4.         A vessel sailing from Baltimore and Skibbereen Harbour which puts back to the harbour due to stress of weather, without having accomplished its intended voyage, shall not, on its return to the harbour, be charged a fixed rate under this Order, where it has paid the appropriate rate before sailing.

5.         The following are revoked -

(a)        the Harbour Rates (Baltimore and Skibbereen Harbour) Order 1981 ( S.I. No. 83 of 1981 ),

and

(b)        the Harbour Rates (Baltimore and Skibbereen Harbour) Order 1989 ( S.I. No. 197 of 1989 ).

Maximum Lighthouse Dues

For every fishing boat, or other vessel engaged in fishing, of 5 tons net registered tonnage or upwards, an annual sum, payable in advance of .....................

Article 2(1)(b)

Maximum Tonnage Rates

 

Description of Charge

Fishing vessels and Cargo and Commercial Vessels of Gross Registered Tonnage (“GRT”):

Rate

Less than 10 tons

Charge per year, payable in advance, of €19.00, or charge per day of €4.75

Not less than 10 tons but less than 20 tons

Charge per year, payable in advance, of €19.00 plus €0.50 per ton of GRT over 10 tons, or charge per day of €4.75

Not less than 20 tons but less than 30 tons

Charge per year, payable in advance, of €31.80 plus €0.50 per ton of GRT over 20 tons, or charge per day of €7.95

Not less than 30 tons but less than 50 tons

Charge per year, payable in advance, of €44.40 plus €0.50 per ton of GRT over 30 tons, or charge per day of €11.00

Not less than 50 tons but less than 75 tons

Charge per year, payable in advance, of €57.10 plus €0.65 per ton of GRT over 50 tons, or charge per day of €14.50

Not less than 75 tons but less than 100 tons

Charge per year, payable in advance, of €69.80 plus €0.65 pre ton of GRT over 75 tons, or charge per day of €17.50

Not less than 100 tons

Charge per year, payable in advance, of €95.20 plus €0.65 per ton of GRT over 100 tons, or charge per day of €24.00

Maximum Rates for Passenger Vessels

 

Description of Charge

Passenger Vessels:

Rate

Up to and including 12 passengers

€38.00 for each entry to the harbour

13 to 20 passengers

€63.50 for each entry to the harbour

21 to 50 passengers

€190.50 for each entry to the harbour

51 to 100 passengers

€444.40 for each entry to the harbour

Over 100 passengers

€507.80 for each entry to the harbour
