The Department of the Environment, in exercise of the powers conferred upon it by Articles 72(1) and (2) and 110(2) of the Road Traffic (Northern Ireland) Order 1995[1] and of every other power enabling it in that behalf, hereby makes the following Regulations:-
Citation and commencement
1.
These Regulations may be cited as the Motor Vehicle Testing (Amendment) Regulations (Northern Ireland) 2003 and shall come into operation on 1st January 2004.
Amendment of the Motor Vehicle Testing Regulations (Northern Ireland) 2003

In regulation 20(2) of the Motor Vehicle Testing Regulations (Northern Ireland) 2003[2] (production of test certificate on application for licence) for sub-paragraph (b) there shall be substituted -
"
(b) the owner of the vehicle declares in writing the year in which the vehicle was manufactured, and a period of 4 years[3], or such other period specified by an order made by the Department under Article 63(9) of the Order, from the date of manufacture has not expired.";

EXPLANATORY NOTE
(This note is not part of the Regulations.)
These Regulations amend the Motor Vehicle Testing Regulations (Northern Ireland) 2003 (the "principal Regulations").
Regulation 20(2) of the principal Regulations provides that where an application is made for a road fund licence, for a vehicle to which Article 63(2)(b) of the Road Traffic (Northern Ireland) Order 1995 applies, and the applicant does not produce a valid test certificate, the licence will not be granted unless the applicant declares in writing the year of manufacture of the vehicle and that a period of 5 years from the date of manufacture has not expired.
These Regulations amend regulation 20(2)(b) so that an applicant must declare in writing the year of manufacture of the vehicle and that a period of 4 years from the date of manufacture has not expired.
