TRANSPORT

The Transport Act 2000 (Commencement No. 3) (Amendment) Order 2001

  Made 22nd January 2001 

The Secretary of State for the Environment, Transport and the Regions, in exercise of his powers under sections 275 and 276 of the Transport Act 2000[1], hereby makes the following Order: - 

Citation
     1. This Order may be cited as the Transport Act 2000 (Commencement No. 3) (Amendment) Order 2001.

Amendment of Part 1 of Schedule 2 to the Transport Act 2000 (Commencement No. 3) Order 2001
     2.  - (1) Part I of Schedule 2 to the Transport Act 2000 (Commencement No. 3) Order 2001[2] is amended as follows.

    (2) After "Sections 212 to 215" insert "(and accordingly Schedule 16)".

    (3) Omit "Section 253".

    (4) After "Sections 232 to 240" insert "(and accordingly Schedule 25)".

    (5) For "Sections 255 to 262 (and accordingly Schedules 29 and 30)." substitute - 

    (6) For "Sections 264 to 268." substitute - 

Amendment of Part II of Schedule 3 to the Transport Act 2000 (Commencement No. 3) Order 2001
     3.  - (1) Part II of Schedule 3 to the Transport Act 2000 (Commencement No. 3) Order 2001 is amended as follows.

    (2) for paragraph 2 substitute -

EXPLANATORY NOTE

(This note is not part of the Order)


This Order amends the Transport Act 2000 (Commencement No. 3) Order 2001 to omit sections 253, 257 to 260, 265, and 267 of the Transport Act 2000 from the provisions specified in Part I of Schedule 2 to that Order, which are brought into force on 1st February 2001.

Section 253 (which contains transitional arrangements for railways) came into force at Royal Assent (together with Schedule 28).

Sections 257 to 260 and 265 contain provisions relating to driver training and driving instructors and the licensing of private hire vehicles. Section 267 (which contains provisions about appeals relating to London service permits) will still be brought into force in part on 1st February 2001 notwithstanding this Order, in accordance with provisions in Part I of Schedule 3 to the Transport Act 2000 (Commencement No. 3) Order 2001, for the purposes of making regulations.

The Order also amends the transitional provisions in Part II of Schedule 3 relating to the commencement of sections 158 and paragraph 22 of Schedule 11, which amend provisions relating to the repayment of fuel grant duty for unregistered and unreliable local services.
