"
After sub-paragraph (1) there is inserted -
"
(1A) For the purposes of this paragraph "electricity supplier" means any public electricity supplier, any holder of a licence granted under section 6(2) of this Act who is also the holder of a licence granted under section 6(1)(c) of this Act or any holder of a licence granted under section 6(2) who is an affiliate of the holder of a licence granted under section 6(1)(c) and an "affiliate" means any holding company, subsidiary or subsidiary of a holding company of such a licence holder in each case within the meaning of sections 736, 736A and 736B of the Companies Act 1985[3].".".
(3) In paragraph (2)(c) for "whose licence has been revoked in accordance with its conditions" there is substituted "to whom notice of revocation of his licence has been given".

EXPLANATORY NOTE
(This note is not part of the Order)
This Order amends the Utilities Act 2000 (Commencement No. 4 and Transitional Provisions) Order 2000 ("the No. 4 Order") by providing a definition of "electricity supplier" in relation to certain provisions of Schedule 4 to the Utilities Act 2000. Those provisions, with transitional modifications, were commenced by the No. 4 Order to provide for deemed contracts to exist in certain instances. The amendments made by this Order clarify those instances.
