INTERNATIONAL IMMUNITIES AND PRIVILEGES

The Specialized Agencies of the United Nations (Immunities and Privileges of UNESCO) Order 2001

  Made 18th July 2001 
  Coming into force in accordance with Article 1

Whereas a draft of this Order has been laid before Parliament in accordance with section 10(1) of the International Organisations Act 1968[1] ("the Act") and has been approved by a resolution of each House of Parliament:

     Now, therefore, Her Majesty, by virtue and in exercise of the powers conferred on Her by sections 1[2] and 10(3) of the Act or otherwise in Her Majesty vested, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:-

     1. This Order may be cited as the Specialized Agencies of the United Nations (Immunities and Privileges of UNESCO) Order 2001 and shall come into force on the date on which Annex IV to the Convention on the Privileges and Immunities of the Specialized Agencies of the United Nations[3] enters into force for the United Kingdom. This date shall be notified in the London, Edinburgh and Belfast Gazettes.

     2. UNESCO is an organisation of which the United Kingdom and other sovereign powers are members.

    
3. The Specialized Agencies of the United Nations (Immunities and Privileges) Order 1974[4] shall apply to UNESCO, its officers and experts and to representatives of Members and other persons mentioned in Article 14 of the Order, in accordance with its terms.

EXPLANATORY NOTE

(This note is not part of the Order)


Although the Specialized Agencies of the United Nations (Immunities and Privileges) Order 1974 applied to and in relation to UNESCO, that application lapsed when the United Kingdom withdrew from the organisation on 31st December 1985. The United Kingdom rejoined UNESCO on 1st July 1997. This Order restores the privileges and immunities previously enjoyed by UNESCO and persons connected with it by re-applying the 1974 Order to them. The Order will come into force on the date on which Annex IV to the Convention on the Privileges and Immunities of the Specialized Agencies of the United Nations (Cm. 855) enters into force for the United Kingdom.
