RATING AND VALUATION, ENGLAND

The Non-Domestic Rating (Former Agricultural Premises) (England) Order 2001

  Made 17th July 2001 
  Laid before Parliament 24th July 2001 
  Coming into force 15th August 2001 

The Secretary of State for Transport, Local Government and the Regions, in exercise of the powers conferred on him by section 43(6F) of the Local Government Finance Act 1988[1] and of all other powers enabling him in that behalf, hereby makes the following Order: - 

Citation, extent and commencement
     1. This Order, which extends to England only, may be cited as the Non-Domestic Rating (Former Agricultural Premises) (England) Order 2001 and shall come into force on 15th August 2001.

Rateable value limits
    
2. £6,000 is the amount prescribed as the amount of rateable value for the purposes of section 43(6F)(b) (mandatory relief on former agricultural premises) of the Local Government Finance Act 1988.

EXPLANATORY NOTE

(This note is not part of the Order)


The Rating (Former Agricultural Premises and Rural Shops) Act 2001 inserts subsection (6F) to (6L) into section 43 of the Local Government Finance Act 1988, thus providing for mandatory rate relief for certain former agricultural premises.

This Order provides that £6,000 is the maximum rateable value of a hereditament which can be eligible for such relief.

[1] 1988 c. 41. Section 43(6F) was inserted by the section 1 of the Rating (Former Agricultural Premises and Rural Shops) Act 2001. These powers are devolved, in relation to Wales, to the National Assembly for Wales; see section 4 of the Act of 2001 and the reference to the Local Government Finance Act 1988 in Schedule 1 to the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672).back
