In exercise of the powers conferred on the Secretary of State[1] by sections 79Q and 79R of the Children Act 1989[2], the Secretary of State for Education and Skills hereby makes the following Regulations:
Citation, commencement and extent
1.
- (1) These Regulations may be cited as the Day Care and Child Minding (Inspections) (Prescribed Matters) (England) Regulations 2001.
(2) These Regulations shall come into force on 1st September 2001.
(3) These Regulations extend to England only.
Interpretation

In these Regulations, "the Act" means the Children Act 1989.
Prescribed interval for inspection of premises

The prescribed interval for the purposes of section 79Q(2) and (3) of the Act (duty on the Chief Inspector to secure that child minding provided in England, and day care provided on premises in England, by a registered person is inspected by a registered inspector at prescribed intervals) is two years.
Prescribed period for making a report to the Chief Inspector

- (1) The prescribed period for the purposes of section 79R(1) of the Act (the period within which the person who has conducted an inspection under section 79Q must report to the Chief Inspector) is 25 days beginning on the day following that on which the inspection is completed.
(2) For the purpose of calculating the period prescribed by paragraph (1), no account shall be taken of any day which is a Saturday, Sunday, Good Friday, or Christmas Day or any day which is a bank holiday in England under the Banking and Financial Dealings Act 1971[3].
Prescribed authorities and persons in relation to the copying of reports

For the purpose of section 79R(3)(b) of the Act, (authorities or persons to whom the Chief Inspector shall send a copy of the report or of parts of the report), -
(a) the prescribed authority is the local authority for the area in which the child minding or day care which is the subject of the report is provided; and
(b) the prescribed person is the registered person whose provision of child minding or day care is the subject of the report.

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations, made under the Children Act 1989, which apply only to England and come into force on 1st September 2001, prescribe -
(a) the interval at which Her Majesty's Chief Inspector of Schools shall secure the inspection by a registered inspector of registered child minding and registered day care in England (two years);
(b) the period within which a person who has carried out such an inspection must report to the Chief Inspector (25 days); and
(c) the authorities and persons to whom the Chief Inspector must send a copy of the report, or parts of the report (the local authority for the area in which the childminding or day care is provided and the registered person).
