The National Health Service (Dental Charges) Amendment (No. 2) Regulations 2001

  Made 3rd August 2001 
  Laid before Parliament 3rd August 2001 
  Coming into force 6th August 2001 

The Secretary of State for Health, in exercise of the powers conferred on him by sections 79(1), 79A and 126(4) of the National Health Service Act 1977[1] and of all other powers enabling him in that behalf, hereby makes the following Regulations: - 

Citation, commencement and extent
     1.  - (1) These Regulations may be cited as the National Health Service (Dental Charges) Amendment (No. 2) Regulations 2001 and shall come into force on 6th August 2001.

    (2) These Regulations extend to England only.

Amendment of the National Health Service (Dental Charges) Regulations 1989
    
2. In regulation 3 of the National Health Service (Dental Charges) Regulations 1989[2] (charges for other dental services), paragraph (2)(e), for "or 13(2)" substitute ", 13(2) or 17(4)".

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations further amend the National Health Service (Dental Charges) Regulations 1989 to provide that no charge shall be made to the patient where a dentist repairs or replaces a filling in accordance with paragraph 17(4) of Schedule 1 to the National Health Service (General Dental Services) Regulations 1992 (repair or replacement of a filling provided by a dentist as occasional treatment).

The functions of the Secretary of State under these provisions are, so far as exercisable in relation to Wales, transferred to the National Assembly for Wales by article 2(a) of the National Assembly for Wales (Transfer of Functions) Order 1999, S.I. 1999/672 as amended by section 66(5) of the Health Act 1999 (c. 8).back
