CRIMINAL LAW, ENGLAND AND WALES

The Drug Abstinence Order (Responsible Officer) (No. 2) Order 2001

  Made 25th October 2001 
  Coming into force 26th October 2001 

The Secretary of State, in exercise of the power conferred on him by section 58A(4) of the Powers of Criminal Courts (Sentencing) Act 2000[1], hereby makes the following Order, a draft of which has been laid before, and approved by resolution of, each House of Parliament in accordance with section 160(3)(a) of that Act:

     1. This Order may be cited as the Drug Abstinence Order (Responsible Officer) (No. 2) Order 2001 and shall come into force on the day after the day on which it is made.

    
2. Officers of local probation boards (within the meaning of section 4(4) of the Criminal Justice and Court Services Act 2000[2]) are hereby specified for the purposes of section 58A(4) of the Powers of Criminal Courts (Sentencing) Act 2000 as persons who may be made responsible for the supervision of offenders subject to drug abstinence orders.

     3. The Drug Abstinence Order (Responsible Officer) Order 2001[3] is hereby revoked in so far as it has any effect in law.

EXPLANATORY NOTE

(This note is not part of the Order)


This Order specifies the description of persons who may be made responsible for supervising an offender's abstinence from specified drugs under the terms of a drug abstinence order. It supersedes the Drug Abstinence Order (Responsible Officer) Order 2001 (S.I. 2001/1815), which was made under an incorrect procedure.
