LOCAL GOVERNMENT, ENGLAND

The Local Government Commission for England (Transfer of Functions) Order 2001

  Made 10th December 2001 
  Coming into force 1st April 2002 

The Secretary of State for Transport, Local Government and the Regions, in exercise of the powers conferred on him by sections 18(1), (2) and (7) and 156(5) of the Political Parties, Elections and Referendums Act 2000[1], hereby makes the following Order, of which a draft has been laid before, and approved by resolution of, each House of Parliament.

Citation and commencement
     1. This Order may be cited as The Local Government Commission for England (Transfer of Functions) Order 2001 and shall come into force on 1st April 2002.

Transfer of functions of Local Government Commission for England
    
2. Subject to article 5, on 1st April 2002 all functions, property, rights and liabilities of the Local Government Commission for England ("the English Commission")[2] shall transfer to the Electoral Commission[3].

Transfer of functions of the Secretary of State
     3.  - (1) On 1st April 2002 the functions of the Secretary of State specified in paragraph (2) shall transfer to the Electoral Commission.

    (2) The functions referred to in paragraph (1) are - 

Accounts
     4. Any functions under paragraph 10 of Schedule 2 to the Local Government Act 1992 in relation to the accounting year beginning on 1st April 2001 which would, but for this Order, have fallen to be discharged on or after 1st April 2002 by the English Commission shall be discharged by the Electoral Commission.

Transfer of Staff
    
5.  - (1) This article applies to any person other than the Chief Executive who immediately before 1st April 2002 is an employee of the English Commission.

    (2) Article 2 shall not operate so as to terminate the contract of employment of any such person but any such contract shall have effect from 1st April 2002 as if originally made between that person and the Electoral Commission.

    (3) On 1st April 2002 - 

    (4) Paragraphs (2) and (3) are without prejudice to any right of an employee arising apart from this Order to terminate his contract of employment without notice if a substantial change is made in his working conditions to his detriment; but no such right shall arise by reason only of the change of employer effected by paragraph (2).

    (5) This article is without prejudice to any provision of the Transfer of Undertakings (Protection of Employment) Regulations 1981[
7].

    (6) In this article "employee of the English Commission" means any individual who works whether under a contract of service or apprenticeship or otherwise but does not include anyone who provides services under a contract for services.

Continuity of the exercise of functions
     6. Anything done by or in relation to the English Commission or the Secretary of State in the exercise of or in connection with a function which by virtue of this Order becomes the function of the Electoral Commission shall so far as is required for continuing its effect on and after 1st April 2002 have effect as if done by or in relation to the Electoral Commission.

Complaints of maladministration by English Commission
    
7.  - (1) The Parliamentary Commissioner may investigate, or, as the case may be, continue to investigate a complaint of maladministration by the English Commission arising in relation to any functions, property, rights or liabilities transferred by this Order.

    (2) In relation to any such investigation begun or continued on or after 1st April 2002, the Parliamentary Commissioner Act 1967[
8] shall apply as if for any reference to the principal officer of the English Commission there were substituted a reference to the principal officer of the Electoral Commission.

Amendments to the Local Government Act 1992
     8. The amendments to the Local Government Act 1992 specified in Schedule 1 to this Order shall have effect.

Amendments to other Acts
    
9. The amendments to other enactments specified in Schedule 2 to this Order shall have effect.

Amendments to the Local Government Act 1992


     1. For section 13 (Duty to conduct reviews and make recommendations)[
9] substitute -

    (2) In subsection (1), for "Local Government Commission" substitute "Electoral Commission".

    (3) In paragraph (a)(iii) of subsection (4), omit the words from "and" to "elected".

     8. In section 21(1) (joint authorities), for "Local Government Commission" substitute "Electoral Commission".

     9.  - (1) Section 26 (orders, regulations and directions under Part II) is amended as follows.

    (2) In subsection (1) after "the Secretary of State" insert "or the Electoral Commission".

    (3) For subsection (3) substitute -

     10.  - (1) Section 27 (amendments relating to local government changes) is amended as follows.

    (2) In subsection (2) for the words "the Secretary of State and the Local Government Commission" substitute "the Electoral Commission and the Boundary Committee for England".

    (3) In paragraph (b) of subsection (2) for "Local Government Commission" substitute "the Electoral Commission and the Boundary Committee for England".

Amendments to other Acts


The Local Government Act 1972
     1. In section 73(2) of the Local Government Act 1972[
18] ("the 1972 Act") (alteration of local boundaries consequent on alteration of water-course) for "Local Government Commission for England" substitute "Electoral Commission".

     2.  - (1) Schedule 11 to the 1972 Act is amended as follows.

    (2) In paragraph 1(1), omit the words "the Secretary of State or".

    (3) In paragraph 3(1), omit the words "the Secretary of State or".

    (4) In paragraph 4(1), omit the words "by the Secretary of State,".

The Local Government and Rating Act 1997
     3.  - (1) Section 9 of the Local Government and Rating Act 1997 (reviews of parishes by local authorities) ("the 1997 Act")[19] is amended as follows.

    (2) In subsection (3), omit the words from "and" to the end.

    (3) After subsection (3) insert - 

    (4) In subsection (4), insert after "mentioned in subsection (3)," "or make the proposals mentioned in subsection (3A),".

    (5) In subsection (5), for the words "include recommendations" substitute "make proposals to the Electoral Commission".

    (6) In subsection (6), for the words "include a recommendation" substitute "make proposals to the Electoral Commission".

     4.  - (1) Section 10 of the 1997 Act (procedure on a review) is amended as follows.

    (2) In subsection (3) -

     5. In section 11(5) of the 1997 Act (petitions for new parishes), omit ",13".

     6.  - (1) Section 12 of the 1997 Act (views of local authority about the petition) is amended as follows.

     10. In section 18(1) of the 1997 Act (considerations in deciding about electoral arrangements) - 

     11.  - (1) Section 22 of the 1997 Act (exercise of functions) is amended as follows.

    (2) In subsection (1), insert at the end "or by the Electoral Commission".

    (3) In subsection (2), for "Local Government Commission for England" substitute "Electoral Commission".

    (4) Omit subsections (3) and (4).

     12.  - (1) Section 23 of the 1997 Act (orders and regulations under Part II) is amended as follows.

    (2) In subsection (1) insert after "regulations" "or power of the Electoral Commission to make an order under section 14(1A)".

    (3) In subsection (8) insert at the end "and to the Electoral Commission".

The Greater London Authority Act 1999
     13. In section 2(4) of the Greater London Authority Act 1999 (membership of the Authority and the Assembly) ("the 1999 Act")[20], for "the Secretary of State" substitute "statutory instrument by the Electoral Commission".

     14.  - (1) Schedule 1 to the 1999 Act (Assembly constituencies and orders under section 2(4)) is amended as follows.

    (2) In paragraph 1 (Changes to Assembly Constituencies) - 

    (3) In paragraph 2 (Comprehensive review of Assembly constituencies) - 

    (4) In paragraph 3 (preparation and submission of report) -

EXPLANATORY NOTE

(This note is not part of the Order)


This Order makes provision for the transfer to the Electoral Commission of all the functions of the Local Government Commission for England ("the LGCE") and of the functions of the Secretary of State in relation to local government and London Assembly electoral changes.

Article 2 transfers all the functions of the LGCE to the Electoral Commission on 1st April 2002.

Article 3 transfers specified functions of the Secretary of State in relation to electoral matters to the Electoral Commission on the same date.

Article 4 makes provision in relation to the LGCE's final accounts and article 5 provides for the transfer of the LGCE's staff to the Electoral Commission.

Article 6 provides for continuity in the exercise of functions and article 7 deals with the future handling of complaints of maladministration made against the LGCE.

Article 8 and Schedule 1 make amendments to Part II of the Local Government Act 1992.

Article 9 and Schedule 2 make amendments to other enactments.

The general effect of these modifications is to substitute the Electoral Commission for the Secretary of State in relation to electoral matters, to provide for reviews formerly carried out by the English Commission to be carried out by the Boundary Committee for England and to enable the Electoral Commission to implement recommendations of that Committee on electoral matters by Order.
