The Secretary of State for Health, in exercise of the powers conferred upon him by sections 8(3) and (4)(d) and 126(3) of the National Health Service Act 1977[1] and of all other powers enabling him in that behalf, hereby makes the following Order:
Citation, commencement and interpretation

- (1) This Order may be cited as the Health Authorities (Establishment and Abolition) (England) Amendment Order 2004 and shall come into force on 9th February 2004.
(2) In this Order -
"the Establishment and Abolition Order" means the Health Authorities (Establishment and Abolition) (England) Order 2002[2]; and
"the Strategic Health Authority" means the Coventry, Warwickshire, Herefordshire and Worcestershire Strategic Health Authority[3] established by the Establishment and Abolition Order.
Change of name of the Strategic Health Authority

The Strategic Health Authority shall be called the West Midlands South Strategic Health Authority instead of the Coventry, Warwickshire, Herefordshire and Worcestershire Strategic Health Authority, and accordingly in column 1 of Schedule 1 of the Establishment and Abolition Order (new Authorities and their Areas) the name "Coventry, Warwickshire, Herefordshire and Worcestershire Strategic Health Authority" shall be replaced by the name "West Midlands South Strategic Health Authority".
3.
The change of name effected by article 2 of this Order shall not -
(a) affect any right or obligation of any person; or
(b) be taken as invalidating any instrument (whether made before, on, or after the day on which this Order comes into force) which refers to the trust by its previous name,
and all instruments and other documents which refer to the trust under its previous name shall be construed as referring to it under its new name.

EXPLANATORY NOTE
(This note is not part of the Order)
This Order amends the Health Authorities (Establishment and Abolition) (England) Order 2002, which established the Coventry, Warwickshire, Herefordshire and Worcestershire Strategic Health Authority.
Article 2 of the Order changes the name of the Strategic Health Authority from the Coventry, Warwickshire, Herefordshire and Worcestershire Strategic Health Authority to the West Midlands South Strategic Health Authority.
