PRIVATE HIRE VEHICLES
The Private Hire Vehicles (London) Act 1998 (Commencement No. 3) Order 2004
The Secretary of State for Transport, in exercise of the powers conferred by section 40(2) of the Private Hire Vehicles (London) Act 1998[1], hereby makes the following Order: -
Citation and interpretation
1.
- (1) This Order may be cited as the Private Hire Vehicles (London) Act 1998 (Commencement No. 3) Order 2004.
(2) In this Order, "the Act" means the Private Hire Vehicles (London) Act 1998.
Commencement of the Private Hire Vehicles (London) Act 1998
2.
- (1) Sections 7 to 11, 22(2), 34(3) and 35 of the Act shall come into force -
(a) for the purposes of existing private hire vehicles as defined by regulation 2 of the Private Hire Vehicles (London) (Transitional Provisions) Regulations 2004[2], on 8th March 2004; and
(b) for all other purposes, on 8th April 2004.
(2) With the exception of section 13(2)(b) of the Act (so far as it relates to the requirement in section 13(3)) and section 13(3), all other provisions of the Act not yet in force shall come into force on 8th June 2004.

EXPLANATORY NOTE
(This note is not part of the Order)
This Order brings into force those provisions of the Private Hire Vehicles (London) Act 1998 not commenced by previous commencement orders. Sections 7 to 11, 22(2), 34(3) and 35 will come into force on 8th March 2004 for the purposes of "existing private hire vehicles" as defined by regulation 2 of the Private Hire Vehicles (London) (Transitional Provisions) Regulations 2004 and on 8th April for all other purposes. The remaining provisions of the Act not yet in force are commenced on 8th June 2004. This does not include section 13(2)(b), so far as it relates to the requirement in section 13(3), which will come into force on 1st April 2006 in accordance with S.I. 2003/580.
