RIGHTS OF WAY, ENGLAND

The Countryside and Rights of Way Act 2000 (Commencement No. 4) Order 2004

  Made 5th February 2004 

The Secretary of State, in exercise of the powers conferred upon her by section 103(3) to (5) of the Countryside and Rights of Way Act 2000[1], hereby makes the following Order:

Citation, interpretation and extent
     1.  - (1) This Order may be cited as the Countryside and Rights of Way Act 2000 (Commencement No. 4) Order 2004.

    (2) In this Order - 

    (3) This Order applies in relation to England only[4].

Appointed day
     2. 13th February 2004 is the day appointed for the coming into force of the following provisions of the Countryside and Rights of Way Act 2000 - 

Transitional provisions
    
3.  - (1) The amendment of Schedule 15 to the 1981 Act, as mentioned in article 2(d)(iii) above, shall not apply in respect of orders made under Part III of that Act before 13th February 2004.

    (2) The amendment of section 31 of the 1980 Act, as mentioned in article 2(e) above, shall not apply in a case where -

This Order brings into force on 13th February 2004 in relation to England the following provisions of the Countryside and Rights of Way Act 2000 - 

This Order contains transitional provisions (article 3).
