CONSUMER PROTECTION

The Enterprise Act 2002 (Part 8) (Designation of the Financial Services Authority as a Designated Enforcer) Order 2004

  Made 24th March 2004 
  Laid before Parliament 29th March 2004 
  Coming into force 21st April 2004 

Whereas the Secretary of State thinks that the Financial Services Authority has as one of its functions the protection of the collective interests of consumers and she is satisfied that it is independent;

     Now therefore the Secretary of State, in exercise of her powers under sections 213 and 277 of the Enterprise Act 2002[1] hereby makes the following Order:

Citation Commencement
     1. This Order may be cited as the Enterprise Act 2002 (Part 8) (Designation of the Financial Services Authority as a Designated Enforcer) Order 2004 and shall come into force on 21st April 2004.

Designation of the Financial Services Authority
    
2. The Financial Services Authority is hereby designated under section 213(2) of the Enterprise Act 2002 as a designated enforcer in respect of all infringements.

    
3. The functions of the Financial Services Authority as a designated enforcer under Part 8 of the Enterprise Act 2002 shall be treated as functions conferred on the Authority under provisions of the Financial Services and Markets Act 2000[2].

EXPLANATORY NOTE

(This note is not part of the Order)


This Order designates the Financial Services Authority as a designated enforcer under Part 8 of the Enterprise Act 2002. Designated enforcers may take action to obtain enforcement orders to restrain infringements of those domestic and Community law provisions in respect of which the enforcer is designated, where those infringements harm the collective interests of consumers. This Order designates the Financial Services Authority in respect of all infringements to which Part 8 applies.

A regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business.
