The Education (Prohibition from Teaching or Working with Children) (Amendment) Regulations 2004

  Made 9th June 2004 
  Laid before Parliament 16th June 2004 
  Coming into force 19th July 2004 

The Secretary of State for Education and Skills, in exercise of the powers conferred upon him by sections 142, 210 and 214 of the Education Act 2002[1], hereby makes the following Regulations:

Citation, commencement and application
     1.  - (1) These Regulations may be cited as the Education (Prohibition from Teaching or Working with Children) (Amendment) Regulations 2004 and shall come into force on 19th July 2004.

    (2) These Regulations apply to England and Wales.

Amendment of the Education (Prohibition from Teaching or Working with Children) Regulations 2003
    
2. The Education (Prohibition from Teaching or Working with Children) Regulations 2003[2] shall be amended in accordance with regulations 3 and 4.

     3.  - (1) Regulation 8 shall be amended as follows.

    (2) In regulation 8(1)(a) omit "subject to paragraph (5), on or after 1st November 1995-".

    (3) At the beginning of regulation 8(1)(a)(i) insert "on or after the date specified in paragraph (5)".

    (4) For regulation 8(5) substitute the following - 

     4.  - (1) Schedule 2 shall be amended as follows.

    (2) After paragraph 14, insert the following -

EXPLANATORY NOTE

(This note is not part of the Regulations)


Regulation 8 of the Education (Prohibition from Teaching or Working with Children) Regulations 2003 provides that those convicted of any of the offences set out in Schedule 2 which involves a child under the age of 16 are in certain circumstances automatically prohibited from carrying out work to which section 142 of the Education Act 2002 applies. These Regulations add various offences under the Sexual Offences Act 2003 and one offence under the Criminal Justice Act 1988 to Schedule 2 with effect from 19th July 2004.

A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business.
