LOCAL GOVERNMENT WALES

The Local Government (Best Value Performance Indicators) (Wales) Order 2005

  Made 8 March 2005 
  Coming into force 1 April 2005 

The National Assembly for Wales, having consulted those persons which it is required, by section 4(3) of the Local Government Act 1999[1], to consult, makes the following order in exercise of the powers conferred on it by section 4(1)(a) and (2) and section 29(1) of that Act.

Name, commencement and application
     1.  - (1) The name of this order is the Local Government (Best Value Performance Indicators) (Wales) Order 2005 and it comes into force on 1 April 2005.

    (2) This order applies only in relation to Wales.

Performance Indicators
    
2. The performance indicators specified for county and county borough councils, including, where appropriate, performance indicators in relation to the exercise by them of functions as waste disposal authorities, are, in relation to the functions identified in the table below, the performance indicators set out in that table.

SCHEDULE 1
Article 2


SOCIAL SERVICES INDICATORS


Indicator Number Headline indicator
NS1 The rate of delayed transfers of care for social care reasons per 1,000 population aged 75 or over.
NS2 The rate of older people (aged 65 or over):

    (a) helped to live at home per 1,000 population aged 65 or over; and

    (b) whom the authority supports in care homes per 1,000 population aged 65 or over.

NS3 (a) the percentage of first placements of looked after children during the year that began with a Care Plan in place; and

(b) for those children looked after whose second review (due at 4 months) was due in the year, a percentage with a plan for permanence at the due date.

NS4 The percentage of children looked after at 31 March who have experienced one or more change of school, during a period or periods of being looked after, which were not due to transitional arrangements, in the 12 months to 31 March.



SCHEDULE 2

HOUSING INDICATORS


Indicator Number Headline indicator
NS5 (a) The number of homeless families with children using bed and breakfast accommodation, except in emergencies; and

(b) The average number of days all homeless households spend in temporary accommodation.

NS6 The average number of working days between homeless presentation and discharge of duty for households found to be statutory homeless.
NS7 The percentage of unfit private sector dwellings made fit, closed or demolished through direct action by the local authority.
NS8 The average number, per 1000 head of population, of:

      (i) units of floating support;

      (ii) bed spaces in direct access;

      (iii) bed spaces in temporary residential accommodation;

      (iv) bed spaces in permanent residential accommodation;

      (v) bed spaces in sheltered accommodation for older people; and

      (vi) community alarm services.




SCHEDULE 3

EDUCATION INDICATORS


Indicator Number Headline indicator
NS9 Percentage of pupil attendance in secondary schools.
NS10 The number and percentage of:

      (i) all pupils (including those in local authority care); and

      (ii) pupils in local authority care, in any local authority maintained learning setting, who attain the age of 16 during the school year and leave full-time education, training or work based learning without an approved external qualification.

NS11 The percentage of pupils eligible for assessment at the end of Key Stage 2, in schools maintained by the local authority, achieving the Core Subject Indicator, as determined by Teacher Assessment.
NS12 The percentage of pupils eligible for assessment at the end of Key Stage 3, in schools maintained by the local authority, achieving the Core Subject Indicator, as determined by Teacher Assessment.
NS13 The average external qualifications point score for 16 year olds, in learning settings maintained by the local authority.
NS14

    (a) The number; and

    (b) the percentage of pupils eligible for assessment, in schools maintained by the local authority, receiving a Teacher Assessment in Welsh (first language):

      (i) at the end of Key Stage 2; and

      (ii) at the end of Key Stage 3.




SCHEDULE 4

WASTE MANAGEMENT INDICATORS

    (a) The total tonnage; and

    (b) percentage

of municipal waste:

      (i) reused and/or recycled; and

      (ii) composted or treated biologically in another way.

NS16

    (a) The total tonnage; and

    (b) percentage

of bio-degradable municipal waste sent to landfill sites.

TRANSPORT/HIGHWAYS INDICATORS

SCHEDULE 6

PUBLIC PROTECTION INDICATORS

NS18 (a) The number of high-risk businesses liable to a programmed inspection or alternative enforcement activity during the year; and

(b) the percentage of these businesses that were liable to a programmed inspection or alternative enforcement activity that were inspected/subject to alternative enforcement activity, as regards:

     -  Trading Standards;

     -  Food Hygiene;

     -  Animal Health; and

     -  Health and Safety.




SCHEDULE 7

ENERGY EFFICIENCY INDICATORS


Indicator number Headline indicator
NS19 (a) Percentage change in carbon dioxide emissions in the non- domestic public stock; and

(b) percentage change in energy use and carbon dioxide emissions in the housing stock.




SCHEDULE 8

HOUSING BENEFIT AND COUNCIL TAX BENEFIT INDICATORS


Indicator number Headline indicator
NS20 Housing Benefit security: - 

    (a) the number of claimants visited per 1,000 caseload;

    (b) the number of fraud investigators employed per 1,000 caseload;

    (c) the number of fraud investigations per 1,000 caseload; and

    (d) the number of prosecutions and sanctions per 1,000 caseload.

NS21 Speed of processing: - 

    (a) average time for processing new claims; and

    (b) average time for processing notification of change of circumstances.

NS22 Accuracy of processing:  - 

    (a) the percentage of cases for which the calculation of the amount of benefit due was correct on the basis of the information available for the decision for a sample of cases checked post decision; and

    (b) the percentage of housing benefit overpayments recovered.




EXPLANATORY NOTE

(This note is not part of the Order)


This order specifies, for Wales, performance indicators by reference to which the performance of county councils and county borough councils, in exercising their functions, will be measured from 1 April 2005.

Article 2 identifies, by reference to the Schedules, which performance indicators will be used to measure performance of which functions for the respective best value authorities.

Schedule 1 to 8 detail the prescribed indicators for different functions as follows:

The Local Government (Best Value Performance Indicators) (Wales) Order 2002 will be revoked by the Local Government (Best Value Performance Indicators) (Wales) (Revocation) Order 2005 which comes into force on the 1 April 2005.
